Considering the death penalty as a social problem is a recent historical development. Capital punishment was an important tool of early modern states; it was only in the eighteenth and nineteenth centuries that it came to be seen as a problematic institution. This essay examines the history of the prison since late the eighteenth century. Following a discussion of the origins of the reformative prison, the essay analyzes its global expansion as a tool for disciplining populations, expanding imperial control, and establishing national legitimacy.
