Cape Fear and the Verdict
As a staple feature of popular culture, films shape our everyday understandings and expectations of relationships among law and violence. This paper compares two films, Cape Fear (1992) and The Verdict (1982). The analysis focuses on moral, jurisprudential and social meanings through which narratives provide validity and legitimacy for consenting to law and limiting violence. These films provide sharply different narratives of the capacity of law…
Property, Law and Violence
Talcott Parsons
Talcott Parsons' critique of utilitarian individualism, possessive forms of property and contract, and instrumentalism provides grounds for a relational and nonreductive analysis of individualism and economy. Rather than defining individualism and economic action through possessions and market relations, individuals and such core economic categories as property, wealth, contract, and profit are established through differentiating social processes…

The Enabling State
Studies of the welfare state have formed an important part of public policy research in America since the Second World War. The Enabling State reconsiders the scope of social welfare transfers, how they are delivered, and whom they benefit. In addition to presenting an analysis of direct public expenditures, the authors examine how welfare benefits are derived from the full range of modern social transfers, including tax expenditures, credit subs…
Michel Foucault
Michel Foucault's writings challenge dominant approaches to the analysis of law.2 For Foucault, law is neither a condition for the liberation of the individual, nor is it solely the result of class domination. Law cannot be adequately comprehended from the standpoints of subjects of action whether they be based on individualism, class, or gender or from the general structures through which everyday life is produced and experienced. Foucault claim…

The Public/Private Distinction
This article reconstructs Marx's approaches to the critique of the public/private distinction in law and analyzes contemporary approaches to public/private distinctions in legal studies. Specifically, I focus on three approaches to critiquing the public/private distinction as legal ideology. These approaches are identified in works by Balbus, Klare, and Kennedy. They have affinities with Marx's analyses and demonstrate the incoherence, mystificat…

Dialectical Phenomenology
Rational Law and Boundary Maintenance
Neo-Marxian critiques of Max Weber's theory of rationality have stressed the ideological role of legal formalism. At the analytic level, however, Weber's theory points to sources of potential conflict between legal formalism and economic rationality. This paper critically reconstructs Weber's perspective for analyzing the boundary maintaining categories of legal discourse. A case study of the 1971 federal loan guarantee to Lockheed Aircraft Corpo…
Privatism and Orientations Toward Political Action
Testing Durkheim
Empirical tests of Durkheim's legal theories can neither confirm nor refute their central hypotheses. Rather than serving to substantiate or refute theoretical propositions, empirical evidence is best conceptualized as providing for the specification and elaboration of a research program. In the case of Durkheim's legal theories, the programmatic effort is to use social science to help resolve the major social, moral, and legal tensions character…
Radical Sociology
The term intersectionality references the critical insight that race, class, gender, sexuality, ethnicity, nation, ability, and age operate not as unitary, mutually exclusive entities, but rather as reciprocally constructing phenomena. Despite this ...Read More
