  • Music industry and copyright protection in the United States and China

Open Access•David Herlihy, Yu Zhang et al.•ARTICLE•Global Media and China•2016

From the standard economic rationale, music copyright supports the rights of authors and creators to exclude competitors and the public from accessing and copying their works to the extent necessary to provide incentive to recover the investment they made in creating those works. The necessary extent in music copyright is from the interplay of three historical drivers of copyright policy—technology (which makes things possible), the market (which…

    David Herlihy•ARTICLE•The Journal of Interdisciplinary…•1995•Citada por: 3

The author reviews recent theories concerning the history of marriage and the significance of differential reproduction in human groups. He argues historians should be sensitive to biological experience--more specifically that they ought to consider the observations and the theories of those biologists who study how living species change through differential rates of reproduction and yet maintain a certain cultural stability. The reasons why mono…

This monumental study of medieval law and sexual conduct explores the origin and develpment of the Christian church's sex law and the systems of belief upon which that law rested. Focusing on the Church's own legal system of canon law, James A. Brundage offers a comprehensive history of legal doctrines-covering the millennium from A.D. 500 to 1500-concerning a wide variety of sexual behavior, including marital sex, adultery, homosexuality, concub…

The justifications for this enterprise are two. The surviving sources give overwhelming attention to the rich and powerful; they pay little heed to the poor and lowl…

The medieval Christian Church was slow in developing a comprehensive theology or canon law of marriage, but it did establish certain principles of great significance in social life. Sexual morality was the same for both sexes, all classes and all nations. Marriage was monogamous, and close or incestuous marriages were forbidden. A uniform sexual morality worked to create uniform or commensurable household units. The requirement of monogamy and th…

What are the new interests, the new methods, and the new conceptions of European economic development which over the past thirty years have formed or reformed our discipline? In partial answer to this difficult question, we shall first consider the economic history of what we may call traditional Europe, and which we shall extend, very roughly, from the early Middle Ages until the seventeenth century

  • The Making of the Medieval Family

    Open Access•David Herlihy•ARTICLE•Journal of Family History•1983•Citada por: 3•Referencias: 2

Across the long centuries of the Middle Ages, households seem to have acquired three distinctive characteristics. In the ancient Mediterranean world, judging from the terminology used to describe them and from the failure to use them as units in social surveys, it appears that households were not commen surable. From the Carolingian age, however, medieval households do appear as commensurable units within a symmetrical array. In other words, the …

  • Three Patterns of Social Mobility in Medieval History

    David Herlihy•ARTICLE•The Journal of Interdisciplinary…•1973•Citada por: 3

Three Patterns of Social Mobility in Medieval History Medieval rulers philosophers repeatedly affirmed that the divine will had established social inequality, that the good Christian should be content with his station in life. Let everyone, Charlemagne instructed his subjects in the early 8oos, serve God faithfully in that order in which he is placed.' In an oft-quoted poem written about the year I000, Adalbero, Bishop of Laon, described the Chri…
