Protective Labor Legislation in the Courts
The Supreme Court's decision in Lochner v. New York (1905), invalidating an act limiting working hours for bakers as a violation of contractual freedom, has come to symbolize an era in constitutional law. The period covers the years from the end of the Gilded Age through the Progressive Era. Its chief characteristic, according to its critics, is the judiciary's hostility to progressive labor legislation. Statutes intended to protect vulnerable cl…

Thomas Jefferson's Liberal Anticapitalism
This article reassesses Thomas Jefferson's political economy in light of debates about the influence of liberal and republican ideas on his thought. I argue that Jefferson embraced liberal premises, but used them to reach anticapitalist conclusions. He opposed neither commerce nor the prosperity it promised; he opposed working for a wage, and he did so on liberal grounds. The first section of this article shows that John Locke's theory of propert…
Private Property versus Markets
This essay assesses communitarian and democratic critiques of capitalist economies. Distinguishing them are sharply contrasting evaluations of markets and private property. Communitarian critics of capitalism trace its moral failure to the marketplace. Drawing on Aristotle's normative economics, this school maintains that production for gain corrodes society's moral fabric. I defend the democratic approach. Democratic critics accept the modern cl…

Households, on the Moral Architecture of the Economy. William James Booth
The Socialist Polis
The central question guiding this essay is: what does Marx's socialism owe to classical antiquity? Underlying this question is the thesis that Marx's studies of classical Greece supply the angle of vision necessary to bring to light the hallmark of his conception of the socialist polity. The argument challenges a widespread interpretation of the connection between antiquity and socialism in Marx's work—that his socialist vision takes its bearings…

Three Views of the Latin American Debt Crisis
This paper examines the Latin American debt crisis from the perspective of three major participants: private and official creditors, the debtors themselves and the US government. Wide differences in the views of these participants on the origins and current status of the crisis help to explain its intractability. The intention of the paper is to offer an account of the broader economic and political context from which the three perspectives arise…
Marx on the Peasantry
Despite its centrality to his work, Marx never offered a systematic analysis of the concept of class, leaving his interpreters to distill its meaning from his historical writings. Marx's usage of the term gave rise to a controversy over the respective roles played by objective conditions and subjective experiences in his definition of class. In one view, Marx defined class exclusively in structural terms by reference to the position of its member…
Social Benefits in Advanced Capitalist Countries
One of the most striking characteristics of the state in the advanced capitalist democracies is the role it plays in the allocation of disposable income. Government policy has, of course, always influenced income distribution through regulation and the provision of public goods, but redistribution is a by-product of such activity, which seeks primarily to accomplish other ends. In contrast, a distinguishing feature of the modem welfare state is i…
The Impact of Taxes in Developed Capitalist Countries
A research question of perennial interest is, “What are the exogenous variables which best account for the differential distribution of income across nations?” Better understanding of the causes of inequalities in income distribution has been sought by investigating the effects of tax policies on income allocation and growth in capitalist countries. The quantitative analyses of these matters have engendered some debate about the adequacy of data,…
The Impact of Taxes on Growth and Distribution in Developed Capitalist Countries
Has the scope of public planning in contemporary capitalist economies promoted or hindered economic growth and income distribution? We explore this question by assessing the impact of various mechanisms for raising government revenues on investment, growth, and income distribution in 22 developed market economy countries. The article considers whether growth and distribution are affected differently by governments' relative reliance on personal a…
