Adaptive landscapes
Climate change is transforming landscapes and land use practices. As the state territorializes climate risk via land use planning instruments, it transforms the operation of legal rights. In the Global North, this is generally understood as imposing constraints on private property rights. In the Global South, the literature focuses on the way planning instruments create or transform property rights. Using case studies from the Philippines, this p…
Data jurisdictions and rival regimes of algorithmic regulation
This article aims to characterize and compare some approaches to regulation manifest in distinct yet intersecting domains of data assemblage and algorithmic development and to explore some implications of their operating in concert. We focus on three such types of domain, each oriented toward different purposes: market jurisdictions, public science jurisdictions, and jurisdictions of humanitarianism. These domains we characterize as data jurisdic…
The Temporality of Disaster
Climate change threatens to destabilise existing humanitarian temporalities, particularly the idea of 'building back better'. Building back better, which involves reducing vulnerability to future harm, depends on our being able to predict, to at least some extent, what the future will be like. Climate change, destabilises our predictive abilities and thus limits our ability to adequately respond to future risk. In response, there is an increased …
Property and the State or ‘The Folly of Torrens
Australian lawyers often extol the virtues of the Torrens system as a means to secure property in land. Yet, the comparative evidence of benefits is mixed and context-dependent, particularly in terms of the nature, provenance and capacity of the state. This article analyses ways in which positivist land laws, including Torrens systems of title by registration, create legal understandings of property that are tied closely to projections or assumpt…
