  • Adjudicating while Fighting

    Open Access•Rachel L Wellhausen, Clint Peinhardt•ARTICLE•Perspectives on Politics•2025•Citada por: 1•Referencias: 46

Russia’s 2014 seizure of parts of Ukraine, notably the Crimean Peninsula, set in motion a flurry of legal activity. Ukraine’s “lawfare” strategy, which aims to fight Russia via international legal means, included explicit encouragement of Ukrainian investors to file disputes under the Ukraine-Russia Bilateral Investment Treaty. We consider the resulting Investor-State Dispute Settlement (ISDS) arbitrations, the first instances of ISDS in which st…

  • Political Risk Insurance

    Open Access•Vincent Arel-Bundock, Clint Peinhardt et al.•ARTICLE•Journal of Conflict Resolution•2020•Citada por: 11•Referencias: 59

When do governments impose costs on foreign firms? Many studies of foreign direct investment focus on incentives for government expropriation, but scholars are often forced to rely on indirect measures of expropriation to conduct empirical analyses. This article introduces a data set which includes information on over 5,000 political risk insurance contracts issued by the US Overseas Private Investment Corporation since 1961, and on all the claim…

  • Deforestation and the United States–Peru Trade Promotion Agreement

    Clint Peinhardt, Alisha A Kim et al.•ARTICLE•Global Environmental Politics•2019•Citada por: 4•Referencias: 9

Do environmental provisions in trade agreements make a difference? In part to coopt environmental criticisms, the United States has included environmental components to trade agreements since NAFTA side agreements in the mid-1990s. Environmental components are increasingly more integrated and more specific, as illustrated by the 2009 United States–Peru Trade Promotion Agreement (PTPA). In exchange for increased market access to the United States,…

  • Governance from Below? Lessons from Transnational Commercial Dispute Resolution

    Open Access•Clint Peinhardt•ARTICLE•International Studies Review•2018

The interactions of subnational actors may offer an alternative to a growing inability of intergovernmental organizations to provide global public goods. In part to investigate such private forms of governance, Thomas Hale examines transnational commercial arbitration (TCA), a long-standing practice that has often succeeded in creating rule of law for cross-border transactions. TCA is also of particular interest to scholars who study investor-sta…

  • Learning and the Precision of International Investment Agreements

    Mark Manger, Clint Peinhardt•ARTICLE•International Interactions•2017•Citada por: 10•Referencias: 20

The international regime for the promotion and protection of foreign investment consists of a multitude of close to 3,000 bilateral investment treaties (BITs) and related international investment agreements (IIAs). Yet, despite a growing body of research on IIAs, scholars in political economy have paid little attention to the legal language in the treaties themselves. In this research note, we draw on the conceptual apparatus of the legalization …

  • Transnational Cooperation

Clint Peinhardt, Tod Sandler et al.•BOOK•Transnational Cooperation•2015

This book presents an analysis of transnational cooperation or collective action that stresses basic concepts and intuition. Factors are identified that facilitate and/or inhibit such cooperation. Elementary game theory is used as a tool for illustrating our ideas and discussion. Game theory shows that rational actors (for example, countries, firms, or individuals) must account for the responses of other rational actors. The book assumes no prior…

  • Evaluating Three Explanations for the Design of Bilateral Investment Treaties

    Open Access•Todd Allee, Clint Peinhardt•ARTICLE•World Politics•2014•Citada por: 52•Referencias: 18

Although many features of bilateral investment treaties (BITs) are consistent from one agreement to the next, a closer look reveals that the treaties exhibit considerable variation in terms of their enforcement provisions, which legal scholars have singled out as the central component of the treaties. An original data set is compiled that captures three important treaty-design differences: whether the parties consent in advance to international a…

  • Contingent Credibility

    Open Access•Todd Allee, Clint Peinhardt•ARTICLE•International Organization•2011•Citada por: 66•Referencias: 29

During the past few decades governments have signed nearly 2,700 bilateral investment treaties (BITs) with one another in an attempt to attract greater levels of foreign direct investment (FDI). By signing BITs, which contain strong enforcement provisions, investment-seeking governments are thought to more credibly commit to protecting whatever FDI they receive, which in turn should lead to increased confidence among investors and ultimately grea…

  • Delegating Differences

    Open Access•Todd Allee, Clint Peinhardt•ARTICLE•International Studies Quarterly•2010•Citada por: 66•Referencias: 31

Bilateral investment treaties (BITs) have become the dominant source of rules on foreign direct investment (FDI), yet these treaties vary significantly in at least one important respect: whether they allow investment disputes to be settled through the International Centre for the Settlement of Investment Disputes (ICSID). Through the compilation and careful coding of the text of nearly 1,500 treaties, we identify systematic variation in "legal de…

  • Government Spending and Public Support for Trade in the OECD

    Judith C Hays, Jude C Hays et al.•ARTICLE•International Organization•2005•Citada por: 144•Referencias: 18

According to the embedded liberalism thesis, governments committed to free trade provide insurance and other transfers to compensate those who lose economically from expanded trade. The goal of this spending is to maintain public support for trade liberalization. We provide a micro-level test of the critical assumption behind the embedded liberalism thesis that government programs designed to protect individuals harmed by imports reduce oppositio…
