On 30 November 2010, the International Court of Justice issued its decision in the merits phase of the Ahmadou Sadio Diallo case. This decision turned on the questions of whether the DRC had violated Mr Diallo's human rights and his rights as a shareholder and manager in two corporations he owned in the DRC. This paper analyses the decision of the Court in the light of the choices it made and the methodology it applied, and demonstrates that both…

In recent years, the European Union (‘eu’) has taken a number of initiatives with a view to co-ordinating consular assistance in third countries. Not only have EU citizens an entitlement to consular assistance by any EU Member State in the absence of a representation of their own, but EU Member States themselves are encouraged to co-operate by means of the Lead State Concept and other forms of co-operation. While this may seem relatively unproble…

  • As If

    Annemarieke Vermeer-Künzli•ARTICLE•European Journal of International…•2007•Citada por: 3

Diplomatic protection is premised on a fiction: injury to an individual is treated as if it constituted injury to the individual's national state, entitling the national state to espouse the claim. While the International Law Commission, in its Draft Articles on Diplomatic Protection acknowledged this legal fiction, it continues to be the subject of debate and criticism. Yet, a closer look at the legal fiction reveals that it enables the applicat…

In the Diallo case, the ICJ was required to answer the question of whether the Republic of Guinea could exercise diplomatic protection not only on behalf of its national, Diallo, but also on behalf of two corporations which were incorporated in the Democratic Republic of the Congo but which were owned by a national of the Republic of Guinea. While the Court decided, in line with Barcelona Traction , that the exercise of diplomatic protection for …

  • A Matter of Interest

    Open Access•Annemarieke Vermeer-Künzli•ARTICLE•International and Comparative Law…•2007•Referencias: 20

International law recognizes two mechanisms for the protection of individuals in case of violations of peremptory norms affecting individuals: invocation of State responsibility erga omnes and diplomatic protection. While they share some fields of applications and are both based on some measure of indirect injury, there are important differences between these two mechanisms. This paper analyses and discusses these differences and similarities, an…
