  • Savickis v. Latvia

Open Access•Cathérine Van de Graaf, Yannick Vincent Schoog•ARTICLE•International Journal of…•2025

On June 9, 2022, the Grand Chamber of the European Court of Human Rights (ECtHR) ruled on Savickis and Others v. Latvia, addressing Latvia’s pension system, which offers preferential benefits to citizens over “permanently resident non-citizens” who chose not to naturalize. This decision marks a departure from the 2009 Andrejeva v. Latvia judgment, which deemed such treatment discriminatory. The Savickis ruling accepted the differential treatment …

  • Countering the Fiction of Neutrality

Open Access•Cathérine Van de Graaf, Angelika Nußberger•ARTICLE•Oxford Journal of Law and Religion•2023

Many scholars accept that the principle of neutrality is to a large extent a fictional concept. They often propose different variations that would better realize its prescribed aim of equality. In this contribution, we argue that state agents in general, and judges in particular, cannot be ‘neutral’ as they are not abstract entities. They do not enter the judiciary with a clean slate but as persons subjected to a myriad of formative experiences, …

    Open Access•Cathérine Van de Graaf•ARTICLE•European Journal of Women s Studies•2023•Citada por: 3•Referencias: 4

In November 2017, after receiving multiple complaints of sexual harassment, the Flemish Radio and Television Broadcasting Organization (VRT) terminated its collaboration with one of Flanders’ most popular TV personalities, Bart De Pauw. What followed was an explosion of opinions from both well-known and ordinary persons. The focus of this article is on the latter: Facebook users commenting on newspaper articles. To gather information about their …

  • Procedural fairness

    Open Access•Cathérine Van de Graaf•ARTICLE•Netherlands Quarterly of Human…•2021•Citada por: 2•Referencias: 1

Fair procedures have long been a topic of great interest for human rights lawyers. Yet, few authors have drawn on research from other disciplines to enrich the discussion. Social psychological procedural justice research has demonstrated in various applications that, besides the final outcome, the manner in which one’s case is handled matters to people as well. Such research has shown the impact of procedural justice on individuals’ well-being, t…

  • Procedural justice perceptions in the mediation of discrimination reports by a national equality body

    Open Access•Cathérine Van de Graaf•ARTICLE•International Journal of…•2020•Referencias: 2

National equality bodies (NEBs) must provide independent assistance to victims of discrimination in complaints about discrimination. As the EU Directive 2000/43/EC only introduced a minimum programme, there is great variety in design at the national level. In this article, the focus lies on the out-of-court approach of the Belgian NEB (Unia) which is founded on dialogue with the involved parties. Based on semi-directive interviews with 18 persons…

  • The local swimming pool as a space of rights contestation – an analysis of ‘burkini’ policies in Belgian local public swimming pools

Tess Heirwegh, Cathérine Van de Graaf•ARTICLE•The Journal of Legal Pluralism…•2019

The authors aim to explore how human rights are implemented and interpreted in the context of ‘burkini’ policies in local public swimming pools. They will analyse four case studies in Flanders based on the involved actors, factors that influence the process, and the actors’ human rights understanding. It will be found that external actors mainly play a role in initiating discussions on the ‘burkini’. Occasionally, their requests seem to be inspir…
