Christian Schools’ Critique of Private School Law Revisions regarding the Recruitment of Teachers Passed in the 21st National Assembly
지난 2021년 8월 31일에 국회 본회의를 통과한 사학법 개정안은 사립 초·중등학교의 교원임용 시 필기시험을 포함하여야 하고 이를 시·도 교육감에게 위탁해야 한다는 내용을 담고 있다. 그 개정의 취지로서 사학의 교원임용 관련 비리 척결을 내세우지만, 이 사학법 개정은 사립학교 교원임용 과정에 대한 감독과 감사 기능을 강화하는 차원이 아니라 사립학교 존립의 본질적 요체라고 할 수 있는 교원임용의 자율성을 근본적으로 훼손하고 있다. 이는 시·도교육감이 직접 사립학교의 교원임용이라고 하는 사학 운영에 개입하여 통제력을 행사하는 위헌적 월권이라고 할 수 있다.BR 교원임용에 관한 필기시험을 교육감에게 강제 위탁하도록 한 사학법 개정은 특히 종교계 사립학교에 심각한 문제를 야기할 소지가 있다. 종교계 사립학교는 종교적 건학이념에 근거하여 설립된 사립학교로서 그 설립 목적을 구현하는 것이 학교의 존립 이…
