In 1969 the Patent Act was amended to permit the issuance of licences to import patented drugs. The Pharmaceutical Manufacturers Association of Canada argues that this change has had a minimal impact on retail drug prices while adversely affecting R & D and the balance of trade. A Department of Industry, Trade and Commerce discussion paper released in 1980 on compulsory licensing takes almost the same position as the PMAC. It presents neither independent analysis nor views other than the PMAC's. This article scrutinizes the PMAC case and questions some of their conclusions about the impact of compulsory licensing
