This article examines the implications of the expanded use of border procedures within the Common European Asylum System (CEAS), focusing on the recently adopted Asylum Procedures Regulation (APR) under the EU Pact on Migration and Asylum. It traces the historical evolution of border procedures, highlighting their transition from exceptional measures to standard practices driven by politcised motives. The APR significantly expands the regulation of border procedures, introducing twelve detailed provisions aimed at modifying the framework for asylum processing at the borders and reinforcing the responsibility of frontline states. However, these changes raise critical concerns regarding human rights and procedural safeguards for asylum seekers, particularly through the application of the ‘non-entry’ legal fiction. This concept complicates the relationship between physical presence and legal rights, potentially undermining the protective legal framework traditionally associated with territorial presence. The main argument of the article is that, while border procedures are framed as ‘necessary’ tools for migration management, they may lead to procedural inequality, disproportionate burdens on frontline states, and significant risks to the rights of asylum seekers at the borders
