The Papal Conception of Empire

Only in recent years have scholars become aware of the importance of the medieval canon lawyers in the development of the concept of empire. 3 In a number of areas of what can be broadly construed as political thought, the canonists made important contributions. While philosophers in the Middle Ages tended to be restricted in their analysis of politics by the Greek, Roman and patristic traditions of political thought, the canonists were not. The canonists who emerged in the late twelfth century following the publication of Gratian’s Decretum were legal practitioners who came to play a major role in the ecclesiastical bureaucracies, on occasion rising to the papal office itself. 4 In carrying out these roles, the canonists faced problems that did not exist in classical political thought. As they did so, they shaped the legal tradition, causing what Harold Berman has termed the ‘legal revolution’ of the twelfth century that in turn created modern European legal systems. 5 These keywords were added by machine and not by the authors.
