L'esthétique recontextualisée
In general, the theme of this paper is future possibilities for aesthetics as a discipline. Critically developing in the future several merely inchoative types of aesthetic reflection today could have important consequences for developing possible new orientations for aesthetics itself tomorrow. In particular, the paper is about future possibilities for aesthetics that may arise from developing rather new kinds of aesthetic reflection in connectio…

New Questions about an Old Concept
In the age of the Charter, courts are an important part of the policy process, and judicial independence is the concept that structures the interactions between courts and other institutions. Historically, judicial independence in Canada was modelled on (and little different from) that of England; but politically-led reforms in the 1970s, and a string of more than a dozen Supreme Court decisions centred on the 1997Remuneration Reference, are tran…

Who Wins and Who Loses in the Provincial Courts of Appeal? A Statistical Analysis, 1920–1990
Given the visibility and obvious importance of judicial power in the age of the Charter, it is important to develop the conceptual vocabulary for desribing and assessing this power. One such concept that has been applied to the study of appeal courts in the United States and Great Britain is “party capability”, a theory which suggests that different types of litigant will enjoy different levels of success as both appellant and respondent. Using a…
Do Women Judges Make a Difference? An Analysis by Appeal Court Data
Given the recent penetration of the judicial profession by women, and concomitant speculation about the possible impact of women judges upon judicial decision-making, the authors examine criminal appeals to the Alberta Court of Appeal between 1985 and 1992 to address in general statistical terms the parameters of the participation of women judges. The results suggest that there is little statistically identifiable difference in the performance of…
Hypotheses, Statistics, and Women Judges
As recipients of a “Comment” longer than our own article, we cannot help being reminded of Abraham Lincoln's story about the man who was being tarred and feathered and run out of town on a rail. Queried by a bystander, the man replied: “Actually, if it wasn't for the honor of the thing, I'd rather walk.” We appreciate the courtesy of the Journal in permitting us to make a brief nonfeminist response to a self-described feminist critique of a nonfe…
Party Capability Theory and Appellate Success in the Supreme Court of Canada, 1949–1992
Now that the advent of the Canadian Charter of Rights and Freedoms has made the fact of judicial power so obvious, it is important to develop the conceptual vocabulary for describing and assessing this power. One such concept that has been applied to the study of United States and British appeal courts is the notion of “party capability theory,” which suggests that different types of litigant will enjoy different levels of success, as both appell…

The Concept of the Self in Political Thought
