The Changing Face of Capital Punishment Films
After the Supreme Court reinstituted the death penalty in 1976, films about capital punishment were written and directed almost entirely by white men. The protagonists and those sentenced to death were largely white and, to avoid antagonizing audiences who might be offended if the films took positions on larger issues, the stories told were those of individuals rather than institutions. The 2019 films Just Mercy and Clemency featured actors, dire…
American Surveillance
In his relatively short book about a topic that he describes as “enormous,” Anthony Gregory begins by reminding readers of the importance of language. Those whose subject is “intelligence” stress its importance in rational foreign policy decision-making, whereas students of “surveillance” are more concerned with how it endangers domestic privacy. As a result, much of their debate consists of talking past each other. Because Gregory believes in th…
Is the Pentagon Papers Case Relevant in the Age of WikiLeaks
LEAKS BY EDWARD SNOWDEN, THE CONVICTION by a military court of Bradley Manning, and the increased number of prosecutions of alleged leakers by the Barack Obama administration provide good reason to reconsider the significance of the Pentagon Papers case.1 Although that ruling “is often said to be a high-water mark in the annals of press freedom,” Adam Liptak has written that, “like the Manning verdict, the decision represented a shift in the unde…
Selecting Presidential Nominees by National Primary
Despite many years of polls indicating overwhelming support for a national primary, it has never advanced far either in Congress or the parties. Opponents have claimed that it would eliminate the possibility of dark horse candidates building on early successes in small states, would dramatically increase the influence of money and mass media, weaken political parties and increase the possibility that a fringe candidate would win the nomination. T…
Scheduling the Party Conventions
Although traditionally the party out of power holds its presidential nominating convention before the incumbent party, there has been little analysis of the origins of this tradition. After reviewing the history of conventions to study when and why this tradition began, this research note then looks at recent changes to see whether it still serves its purpose. Because of these changes, particularly the reformed rules of campaign financing, I conc…

Lyndon Johnson
Because most of the discussion of the second volume of Robert Caro's (1990) biography of Lyndon Johnson has focused either on his charge that Johnson's victory over Coke Stevenson in the 1948 Texas Senate election was gained through fraud or on the accuracy of the extremely negative picture of Johnson as compared to the heroic portrait of Stevenson, other important issues have been overlooked. In his introduction, Caro writes that he has devoted …

Lyndon Johnson and the Public Polls
This article examines the relationship between President Lyndon Johnson and those who take published polls. As his poll ratings declined, Johnson used a number of methods to convince those with influence that he was more popular than the polls indicated. These methods included direct and indirect attacks on the polls, leaks of private polls, attempts to influence the results, and courting the pollsters. The article argues that the last of these p…
