Revisiting the ‘Violence We Have Lost’: Homicide in Seventeenth-Century Cheshire
It is now generally accepted that there was a fall in the number of homicide prosecutions in early modern England, perhaps signifying broader shifts in violent behaviour. So far, however, apart from J.S. Cockburn’s 1991 study of long-term developments in homicide prosecutions in Kent, there has been little in-depth analysis of this transition. This article provides a detailed study of homicide prosecutions in Cheshire over the seventeenth century…

Courts, crime and litigation in the Isle of Man, 1580-1700
This article consists of a survey of the court system and legal records of the Isle of Man in the early modern period. It breaks new ground in studying the massive archives of a unique legal system. The archives reveal both qualitative details of how the Manx legal system functioned and quantitative details of patterns of litigation. Levels of litigation were high, but were far lower in the late seventeenth than in the late sixteenth century. Inv…

Witchcraft and women in seventeenth-century England: Some Northern evidence

Plebeian Marriage in Stuart England: Some Evidence from Popular Literature
THERE is a considerable body of opinion which holds that marriage in early modern England, and especially marriage among the lower orders, was uncaring, affectionless, and entered into for economic rather than emotional reasons. This view was, for example, axiomatic to those writing from a feminist perspective in the 1970s. Thus Sheila Rowbotham felt that in the pre-industrial world The peasant judged his woman by her capacity to labour and to br…

Domestic Homicide in early modern England
One of the most striking features of recent writing on early modern social history has been the emergence of the family as a subject of central concern. As befits an historical area being subjected to new scrutiny, much of this concern has expressed itself in the form of specialized, and often narrowly-focused articles or essays. 1 To these have been added a number of more general works intended to examine the broader developments in and implicat…

The history of crime in late medieval and early modern England: A review of the field∗
Over the last decade or so the history of crime, law and order, and attitudes to such matters, has emerged as a subject of central importance to social historians. An increasing number of scholars in Europe, North America and Australia are working on the history of crime, covering every period from the Dark Ages to the twentieth century. Their labours, despite unusually difficult problems of methodology, source criticism and definition, are begin…
