Interdisciplinary research has long been suspect within the disciplines. Because the disciplines control recruitment, tenure, and promotion, it is difficult for interdisciplinary scholarship to gain traction in the academic world. Within socio-legal scholarship, the Law and Society Association has been instrumental in fostering interdisciplinary and, more recently, transnational research. The association's latest and certainly one of its most pro…

  • Cause Lawyers and Social Movements

Austin Sarat, Stuart A Scheingold•BOOK•Cause Lawyers and Social Movements•2006

Cause Lawyers and Social Movements seeks to reorient scholarship on cause lawyers, inviting scholars to think about cause lawyering from the perspective of those political activists with whom cause lawyers work and whom they seek to serve. It demonstrates that while all cause lawyering cuts against the grain of conventional understandings of legal practice and professionalism, social movement lawyering poses distinctively thorny problems. The edi…

On January 17, 2004, our friend and colleague, Jim Townsend, died peacefully in the midst of his family after a long illness. For many years a leading figure among China scholars, Jim received his Ph.D. from U.C. Berkeley in 1965. He was a member of the political science department at Berkeley between 1963 and 1968 when he moved to the University of Washington. He remained at the University of Washington until he retired prematurely in 1992 after…

This new political criminology is distinctive in three ways: • It is criminology in that it is rooted in conceptions of, and concerns about, the ramifications of street crime. • It is political in that its focus is on the way crime control strategies both refl…

For more than two decades, the United States has been at war with street crime, but we have precious little to show for it. Our obsession with punishment at the expense of, indeed to the exclusion of, prevention is not just futile but criminogenic and divisive. This article explains what is problematic about our indiscriminately punitive response to street crime and explores the political forces driving these self-defeating policies. What emerges…

We are grateful for the thoughtful responses to our study of the Washington State Community Protection Act (Braithwaite & Pettit 1994; Daly 1994). These responses underscore the importance of pushing beyond our case study and point to a variety of promising ways to determine the extent to which the problems we uncover in Washington are typical and/or idiosyncratic

This article focuses on the Community Protection Act (CPA), the State of Washington's legislative effort to control sexual violence, and on the victim advocacy groups that played a prominent role in this effort. It is argued by some, most recently by republican criminologists, that victim advocates serve democratic ideals and introduce into criminal process important values and interests that are neglected by professionals. There is a good deal of scepticism about radical lawyers. Some would go so far as to argue that radical lawyering is a contradiction in terms. First, there is a double distrust of rights, the principal tool of radical lawyers. Rights are seen both as empty promises which do not have significant policy consequences and as integrally implicated in the prevailing hegemony and, therefore, hardly a credible weapon against it.1 The companion complaint …
