An eighth-generation Charlestonian with a prestigious address, impeccable social credentials, and years of intimate association with segregationist politicians, U.S. District Court Judge Julius Waties Waring shocked family, friends, and an entire state in 1945 when, at age sixty-five, he divorced his wife of more than thirty years and embarked upon a far-reaching challenge to the most fundamental racial values of his native region. Tinsley E Yarbrough•ARTICLE•Journal of Policy Analysis and…•1982•Cited by: 1

Judge Johnson's remarkable role in the reform of Alabama's mental health and prison facilities suggests that judges may have greater control over the agendas of policymaking than is normally assumed. In omnibus cases, the judge may be more interested in pushing state officials in the "right" direction than in securing full compliance with any specific set of absolute standards. The tenor and pace of implementation, moreover, may depend largely on…

  • Federal Alienage Doctrine and the Iranian Student Litigation

    Tinsley E Yarbrough•ARTICLE•Human Rights Quarterly•1982

A regulation hastening deportation of Iranian students whose student status had lapsed was one of the more disturbing reactions of the Carter administration to the seizure of American hostages in Tehran. This article examines the ultimately unsuccessful court challenge to this regulation in light of the Burger Court's approach to alienage classifications. The article consists of three parts: an initial section summarizing the Burger Court's posit…

    Young-Dahl Song, Tinsley E Yarbrough•ARTICLE•Public Administration Review•1978•References: 2

Politically and economically, few matters are as important as the taxes people pay to their government. Justice Holmes once described taxes as a mark of the privilege of citizenship in a civilized society, but for most of us it is an unwelcomed burden to be endured. Remote and intangible governmental benefits, vast as they may be, are less likely to be appreciated than the immediate benefits individuals receive for their money in the private mark…
