  • Lawless Zones, Rightless Subjects

Open Access•Hiroshi Motomura, Elizabeth F Cohen et al.•BOOK•Lawless Zones, Rightless Subjects•2025

Responding to ever-increasing pressures of migration, states, supranational, and subnational actors deploy complex moves and maneuvers to reconfigure borders, rights, and territory, giving rise to a changing legal cartography of international relations and international law. The purpose of this volume is to study this new reconfiguration of rights, territoriality, and jurisdiction at the empirical and normative levels and to examine its implicati…

  • A Critical Phenomenology of Racialized Vulnerability

    Open Access•Ayten Gündoğdu•ARTICLE•American Political Science Review•2025•References: 15

This article examines the problem of racialized vulnerability to systemic violence by engaging with the works of Judith Butler and discussing police brutality. Butler has been criticized for presupposing vulnerability as an ontological condition inherent in embodied life and obscuring the distinctive characteristics of racialized vulnerability. Wrestling with these criticisms, the article reads this presupposition as a “contingent foundation,” an…

  • Solidarity as Legal Mobilization

Open Access•Çiğdem Çidam, Çiğdem Çıdam et al.•ARTICLE•AJIL Unbound•2025•Cited by: 1

The criminalization of humanitarianism has become prevalent in the Global North.1 Overbroad definitions of the crimes of migrant smuggling and the facilitation of irregular migration are commonplace in Europe and the United States,2 despite their well-known perverse effects on the rights of organizers and civil society at large. The "crimmigration"3 paradigm is so pervasive that there is little debate across the political spectrum on the legitima…

  • Animal Trouble

    Open Access•Ayten Gündoğdu•ARTICLE•The Review of Politics•2024•References: 3

This article examines animals and animality in Hannah Arendt's political thought by focusing on the phenomenological approach she develops in The Life of the Mind . Building on the works of Adolf Portmann and Maurice Merleau-Ponty, Arendt invites us to understand the world in terms of the plurality of all living things who appear to each other in anticipation of being perceived in their distinctness. While Arendt's phenomenology is generative for…

  • Disagreeing with Rancière

    Ayten Gündoğdu•ARTICLE•Polity•2017•Cited by: 15•References: 22

Jacques Rancière's understanding of politics centers on the struggles of disenfranchised or marginalized groups who demonstrate their equality and become political subjects by exercising the very capacities they supposedly lack and by enacting the rights they are not entitled to claim. Rancière uses the term "political subjectivation" for such struggles. He associates this process with "dissensus," or a logical or argumentative confrontation over…

  • A Revolution in Rights

    Open Access•Ayten Gündoğdu•ARTICLE•Law Culture and the Humanities•2012•Cited by: 1

This commentary aims to bring to the fore the revolutionary elements of the democratic politics inaugurated by the 1789 Declaration of the Rights of Man and Citizen. This founding event places rights at that gap or hiatus between constituent and constituted power, and it reminds us that rights are not simply normative constraints on an existing political and legal order but also democratic inventions that can institute a new order. The commentary…

  • Perplexities of the rights of man

    Open Access•Ayten Gündoğdu•ARTICLE•European Journal of Political…•2012•Cited by: 10

This article provides a new interpretation of Hannah Arendt’s critical analysis of the ‘perplexities of the Rights of Man’ by drawing attention to its overlooked methodological orientations, especially its ‘aporetic’ nature. Arendt’s critique is aporetic as it centres on the paradoxes of human rights and analyses them by putting into practice a mode of inquiry that she associates with Socrates. The article challenges the conventional understandin…
