Between Social and Legal Legitimations
This article examines the case of Israeli Jews who choose to marry in ceremonies outside the state-authorized rabbinical establishment. Formally speaking, these private marriages are not recognized by the State. We focus on the ways in which these marriages become legitimate. The study is based on interviews with forty such couples. Our findings show that these couples tend to attach far more weight to achieving social legitimacy for their marria…
The UN Convention on the Elimination of All Forms of Discrimination Against Women and its Optional Protocol
This volume is the fully revised and updated version of the first comprehensive Commentary on the Convention on the Elimination of All Forms of Discrimination against Women and its Optional Protocol. It reflects the developments during the decade following the publication of the first edition in 2012, which has also seen a notable rise in individual complaints and investigations. The Convention is a key international human rights instrument and t…
Backlash Goes Global
In every country and every culture, the level of equality in the family has a direct impact on all aspects of women's participation in economic, social, cultural, and political life as well as in their exposure to violence. Its significance as a human rights issue is underscored by the level of overt and covert resistance to the pursuit of equality in families in all regions of the world. This article explores the major local and global expressio…
Between Universal Feminism and Particular Nationalism
This article argues that one of the many "idiosyncrasies" of the Israeli case, namely Israel's continuing, violent conflict with its Arab neighbours, is of highly influential relevance to the issue of gender relations. Viewed by many Israeli Jews as a struggle for the very existence of the Jewish state, the Arab-Israeli conflict has overshadowed most other civil and social issues, rendering them "secondary" to the primary concern of securing the …
Divorce Israeli Style
This study examines how the power of women is constructed by divorce professionals in a divorce process that is governed by rabbinical family law, the egalitarian ideology of the recently established family courts, and the growing use of mediation in divorce disputes. It is based on 254 questionnaires and 57 interviews with lawyers, mediators, and lawyer‐mediators. We found that except for a minority of women lawyers, practitioners claimed that w…
