  • Linking Essentialist and Constructivist Ethnicity

    This article argues that the essentialist and the constructivist positions within theories of ethnicity are in fact compatible if one introduces a concept here called “internalized fluid capacities”, connoting that which is inherently (genetically) dispositional – and in that sense biologically “anticipated” – but which remains to be developed into observable social characteristics through sociocultural impact.     In 1998 a lawsuit was filed at the Umea District Court, Sweden, by 120 landowners in Nordmaling against the three Saami villages of Ran, Vapsten and Umbyn. The complaint concerned the entitlements to lands in the territory of Nordmaling, owned by the plaintiffs but habitually accessed by the Saami as winter pasture for their reindeer. The question was whether the Saami villages fulfilled the legal requirements of use over rime and had the right t…

  • Secessions, interventions, and the case of Kosovo

    This paper examines the question of secession – what causes it, when it is justified, whether force can be used, and what can be done to make secession unnecessary. It goes on to explore the question of intervention in terms of precedents and the UN charter. In the case of Kosovo it attempts an ethical evaluation of Operation Allied Force, making use of the 'just war' criteria as a framework. Conclusions are drawn, on the whole favourable to NATO
