The French Bataclan Trial as a judicial experiment: What lessons for the prosecution of mass crimes
Although criminal trials are primarily designed to repress individual acts, a new role has emerged in the era of French jihadist trials. They have transformed into a ‘forum’ giving voice to different actors to comprehend the phenomenon in all its complexity, as in truth commissions: defendants presented their path to radicalization, victims related their trauma, experts situated jihadism in a socio-political context, and security forces disclosed…
Engaging with court research: The case of French terror trials
Transnational legal research often tends to overlook the local management of justice. It often moves too quickly from the local to the trans/global level, without taking the necessary time to investigate local practices. In addressing this research gap, my aim is to “re-localize“ studies within their geographical context and analyze the trans/national dynamics from within, using a bottom-up approach based on ethnography. This article presents a p…

Theorizing empirical court research: The test case of the trial of Hissène Habré
The purpose of this article is to advocate for new methods of studying international law. Hissène Habré, former President of Chad, was convicted by a hybrid tribunal in Dakar. Our book on this judicial process ( The President on Trial: Prosecuting Hissène Habré , Oxford University Press, 2020) develops a novel empirical format of first-person testimonials, followed by expert analyses, to trace and contextualize the decades-long story of attempts …

Transnational Jihadism and the Role of Criminal Judges: An Ethnography of French Courts
Lower national courts are increasingly asked to perform a transnational role, being directly involved in major geopolitical issues such as conflicts, migration, and transnational terrorism. Based on an ethnography of French criminal courts, this article aims to examine this emerging role of national lower courts as transnationalized players. Through an examination of terrorism prosecutions in France and the positions of the different judicial act…
French foreign fighters: The engagement of administrative and criminal justice in France
Since 2012, it is estimated that 2,000 French nationals have joined jihadist armed groups listed by the UN as terrorist organizations in Syria and in Iraq. Consequently, a new prosecution policy has been introduced in France. To date, more than 200 persons have been prosecuted and 1,600 persons have been placed under criminal investigation. In parallel, after the 13 November 2015 terror attacks in Paris, a State of emergency was declared. Persist…
Building respect for IHL through national courts
Respect for international humanitarian law (IHL) comes in many forms, one of which is through the practice of domestic courts in addressing IHL-related cases. This article takes a closer look at the structural conditions necessary for the effective enforcement of IHL by domestic courts, elaborates on the spectrum of options that are available to national judges when faced with IHL-related cases, and describes the functional roles of courts in ado…
Israel’s Unwillingness? The Follow-Up Investigations to the UN Gaza Conflict Report and International Criminal Justice
Following Israel’s ‘Operation Cast Lead’, the UN called upon the Israeli and Palestinian authorities to conduct investigations and prosecutions of international crimes in accordance with international standards. The measures that the Israeli authorities undertook, when carefully examined, fall short of international standards. When examined under the lens of the admissibility criteria of the complementarity principle under Article 17 of the ICC S…
The judicial arm of the occupation: The Israeli military courts in the occupied territories
Since the beginning of the Israeli occupation more than 200,000 cases have been brought before military courts, where Palestinian civilians have been prosecuted and judged by the military authorities. However, despite the large number of judicial decisions, this jurisprudence has not received the attention it merits. Academic researchers and NGOs have usually examined the procedural rights of the accused and have only rarely dealt with other lega…
