A Conversation on Feminism, Ableism, and Medical Assistance in Dying
This article explores the recent expansion of Medical Assistance in Dying (MAiD) in Canada and its negative implications for women with disabilities. In 2021, the government extended MAiD to people with disabilities who are not dying, which the authors contend is a modern form of eugenics. Structured as a conversation and deploying a systemic, equality-based feminist analysis, the article tracks the shifts in scope and justification for MAiD thro…
Penalizing women’s fear
This paper explores Canadian family law cases involving claims of parental alienation and of family violence from 2014–2018, reporting the data on these claims, their resolution, and their impacts upon custody and access. We suggest that the rise of shared par…

Bien que ces deux gouvernements aient adopté des lois qui limitent de la même façon l’utilisation de cette défense, l’origine de ces réformes et leurs processus sont différents. Le présent article analyse la défense réformée du point de vue de son incidence sur les tro…

It is a book with a dramatic subject, the possible wrongful, or unjust, conviction of Kathleen Folbigg for the serial murder of her children. 4 The trial was held in 2003 in New South Wales, Australia. Emma’s book is a tour de force, with analysis of the trial transcripts, …
The intoxication defense in Canada
This paper examines the impact on women — as victim/witnesses and as accused persons — of the Supreme Court of Canada's decision in R v. Daviault regarding the defense of intoxication.Prior to the decision in Daviault, the defense of intoxication was available for only one class of criminal offenses: those described as specific intent offenses (defined below). The defense was therefore absolutely barred for all other offenses, including sexual as…
