The National Supervision Commission
This article explores the history of state supervision organs in the People’s Republic of China (PRC) from the early attempts to establish supervision organizations in communist revolutionary base areas to the founding of the National Supervision Commission in 2018. In the PRC today, the power to supervise the activity of state organs is not autonomous but is rather part of the disciplinary powers of the Chinese Communist Party. This type of inst…
The United Front Principle
This paper contributes to existing work by exploring how the idea of the United Front in China has gradually changed and developed over time. This has had the power to shape policies and institutions which, at least in the intentions of their reformers, will have a definite impact outside the borders of the People’s Republic of China
Justice
Claims about a pursuit of justice weave through all periods of China's modern history. But what do authorities mean when they refer to 'justice' and do Chinese citizens interpret justice in the same way as their leaders? This book explores how certain ideas about justice have come to be dominant in Chinese polity and society and how some conceptions of justice have been rendered more powerful and legitimate than others. This book's focus on 'how'…

Sovereign Power and the Law in China
In China the coexistence of arbitrary detention and a transition towards a rule of law is either seen as an oxymoron, or as an aberration. This book analyses under-researched institutions and practices in China's criminal justice system, arguing that derogations from the rule of law constitute an organic component of the legal order. Hidden behind the law, there lies sovereign power, a power premised on the choice to handle certain issues through…

Shuanggui and Extralegal Detention in China
This study on detention fills a gap in scholarship on China's criminal justice system. This article describes shuanggui, a form of detention used on Party members. It traces the historical legacies linking shuanggui to forms of detention practiced in imperial China and in Chinese Communist Soviets. The article then moves on to describe the birth of shuanggui and the evolution of norms regulating it. Finally, it points out how shuanggui is being r…
