  • Moral Time

    Donald J Black, Donald Black•BOOK•Moral time•2011

Conflict is ubiquitous and inevitable, but people generally dislike it and try to prevent or avoid it as much as possible. So why do clashes of right and wrong occur? And why are some more serious than others? This book presents a new theory of conflict that provides answers to these and many other questions. The heart of the theory is a completely new concept of social time. The book claims that the root cause of conflict is the movement of soci…

  • The social structure of right and wrong

Donald J Black•BOOK•The social structure of right and…•1998

This revised paperback edition features a new prologue and updated citations. The book extends the theoretical approach of Black's classic Behavior of Law (Academic Press, 1976) to a dramatically larger universe: the handling of conflict across societies and history. It also introduces and illustrates Black's "pure sociology," a new theoretical paradigm applicable to human behavior of every kind.

    Donald J Black, Donald Black•ARTICLE•American Sociological Review•1970•Cited by: 186•References: 7

This paper makes problematic the situational conditions under which policemen write official crime reports in field encounters with complainants. These reports are the raw materials for official crime rates-crimes known to the police. They also are a prerequisite of further investigation of the crime by the detective bureau and thus of apprehension of the offender. They constitute official recognition of crimes. The findings derive from a three-c…

The relative absence of formal provision for the resolution of conflict among organizations in the American legal system results in each one controlling others in the system through constraints on the processing of people and information as inputs to their own organization. This paper focuses on the specific case where the courts attempt to control the behavior of the police through the exclusionary rule, particularly as set forth in the Miranda …
