Informal international law-making
Over the last two decades, international humanitarian law (IHL) has seen a stalling with regard to States’ willingness to adopt treaties or to be formally involved in the development of IHL. This raises the question of whether holding on to the doctrine of sources as laid down in Article 38 of the Statute of the International Court of Justice is the only way to meaningfully further develop IHL. Indeed, in recent years IHL instruments have often d…
Introducing New Frontiers in Children’s Rights
This article introduces the special issue ‘New Frontiers in Children's Rights: From Protection to Empowermen’. It gives an overview of new frontiers in children's rights. It also takes a historical perspective on children's rights, including on their legalisation to situate the concept of empowerment therein. It then gives an overview of the special issue's five contributions on children's economic and labour rights, political rights, rights to g…
Covid-19 and the Trials and Tribulations of Global Health Governance
The Covid-19 pandemic has brought to the fore significant shortcomings in global health governance. Faced with the rapid international spread of the virus, international actors unsuccessfully attempted a coordinated international response to tackle the Covid-19 outbreak and its far-reaching repercussions. The present article aims to shed light on certain flaws in the existing global health governance architecture that have thwarted both formal—th…
Filling Global Governance Gaps in Cybersecurity
The many recent cyber incidents have shown how cybersecurity has entered the realm of international relations. Several international organizations have taken cybersecurity policy initiatives, notably the United Nations (UN) and the European Union (EU). Both organizations aspire to a leading role in enhancing cybersecurity resilience. To date, however, these initiatives have not resulted in much regulation. This article examines which factors make…
Between aspirations and realities
A European Perspective on the G20 and the BRICS
This article considers how the European Union (EU), as the most developed regional organization and as one of the strongest global economic players, deals with the global summitry of club-like entities such as the Group of 20 (G20) and the BRICS grouping of Brazil, Russia, India, China and South Africa. The EU, the G20 and the BRICS share similar ambitions, namely addressing global (or regional) cross-border challenges by increasing cooperation a…
Assessing the Legality of Decisions
This chapter examines the legal/judicial accountability of international organizations (IOs). ‘Judicial review’ in reference to acts of IOs has been defined as ‘a process by which a court of law determines whether a legal person has acted substantively within the scope of its powers and procedurally in a correct manner’. Using this definition of review, we find that there is a serious lack of judicial review of acts of IOs at the international le…
Rule Intermediaries in Global Labor Governance
The International Labour Organization's (ILO's) Declaration on Fundamental Principles and Rights at Work is a "canon" in the global governance of labor rights. The ILO has its own implementation, monitoring, and enforcement system in place to foster compliance with the declaration. However, other transnational regulatory initiatives also integrate the declaration into their standards and procedures, leading them to become nondelegated intermediar…

The World Bank Legal Review Volume 6 Improving Delivery in Development
In recent years, better delivery in development has been at the center of development discourse. There is now wide agreement that today’s development challenges demand effective solutions that fully integrate the aspirations, voices, needs, and support of citizens. But how can the international community translate that realization into practical accomplishment? Volume 6 of The World Bank Legal Review examines delivery challenges through the lens …

The European Union and Global Multilateral Governance - An Interdisciplinary Research Project
In previous editions of the Journal of Contemporary European Research, we reported on the set-up and progress of the interdisciplinary research project “The European Union and Global Multilateral Governance” (see Vol. 4, No. 1; Vol. 5, No. 1). This third and final research note presents some of the key-results of the project and suggests future areas for research

Jesp Symposium
This symposium considers Europe's global social policy through an exchange of ideas between scholars with different areas of expertise. The lead article provides an overview of the EU's objectives and instruments in promoting the social dimension of globalization, illustrating its focus on international labour standards and the International Labour Organization (ILO), and the shift from trade measures to a broader spectrum of soft external policy…
The International Criminal Court's Office of the Prosecutor
This contribution critically appraises the institutional position which is held by the International Criminal Court's Office of the Prosecutor. Especially, it will be asked whether and to what extent the latter is « independent » in its activities, or whether and to what extent other actors – both inside and outside the Court – can hamper the Office of the Prosecutor's margin to independently manoeuver. Against the background of the debates prece…

The Prohibition of Genocide as a Norm of Ius Cogens and its Implications for the Enforcement of the Law of Genocide
Successful Protect-Community Discourse
Protect-community movements across America are alive and well. The authors examine one such movement in a Chicago working-class neighborhood-Pilsen. They focus on a discourse oppositional to gentrification that has effectively mobilized space and historicity to speak its truths. The results reveal that diverse mental spaces were constructed and used in discourse to offer two critical constructions: positive resident identities, and developers as …
The Judgement of the International Court of Justice in the Arrest Warrant Case
The author critically analyzes the judgement rendered by the ICJ on 14 February 2002, in the Arrest Warrant of 11 April 2000 case. The Court's reasoning is criticized for both its poor motivation in acknowledging the existence of a rule of customary international law, providing for absolute inviolability and immunity for incumbent ministers for foreign affairs before the national courts of other states, and for the rather theoretical manner in wh…
Spatiality and Growth Discourse
This article examines the prominent growth discourse that today characterizes Midwest rust belt cities. We extend present work on this topic by investigating how these Midwest coalitions construct their two central themes: an accelerated city competition in new global times and the need for leadership by entrepreneurial-minded developers. Our study of St. Louis, Indianapolis, and Cleveland looks at the key ingredients found in these discourses, a…
The Use of Small‐Angle X‐Ray Diffraction Studies for the Analysis of Structural Features in Archaeological Samples
X‐ray diffraction or scattering analysis provides a powerful non‐destructive technique capable of providing important information about the state of archaeological samples in the nanometer length scale. Small‐angle diffraction facilities are usually found at synchrotron sources, although the potential of a laboratory source is also described. Specific examples of analysis using X‐ray diffraction of historic parchment, archaeological bone, a Centr…
