  • The Law of International Development

    Philipp Dann•CHAPTER•Oxford Handbook of International…•2023

This chapter studies the connection between law and development by focusing on its legal core: the law of development. It argues that we have to understand this body of law if we want to critically address questions about power asymmetries and agency, accountability, and human rights in the governance of development. To understand the law of development, the chapter sketches the broader historical, theoretical, and anthropological context arguing…

Der Band untersucht die Rolle der Rechtswissenschaft im deutschen Kolonialismus und koloniale Kontinuitäten im deutschen Recht. • The Battle for International Law: South-North Perspectives on the Decolonization Era

Max Henry Mayer, Jochen Von Bernstorff et al.•BOOK•Battle for International Law•2019

The so-called ‘decolonization era’ witnessed a fundamental challenge to (legalized) Western hegemony through a new vision of the institutional environment and political economy of the world. It is during this era, arguably couched between classic European imperialism and a new form of US-led Western hegemony, that fundamental legal debates took place over a new international legal order for a decolonized world. These debates consist in essence of…

This article analyses the World Bank’s environmental and social Safeguards against the backdrop of changing paradigms of global legal order. In January 2017, a new ‘Environmental and Social Framework’ (ESF) entered into force and replaced older ‘Safeguard Policies’ that had incrementally emerged since the 1980s in response to harmful impacts of investment projects financed by the Bank. The Safeguards reform epitomizes the changing structures and …

One of the primary means of democratic subversion is constitutional amendment. In transitional democracies, it is not unusual for the constitution to include substantive constraints on the amending power as a hedge against the polity's uncertain commitment to the rule of law.Although the Indian Constitution has no such provision, its Supreme Court has taken the controversial position that the Constitution has an unalterable "basic structure".Under…
