  • Pro Bono Pacis et Concordie

Open Access•Dave Postles, Dave Fogg Postles•ARTICLE•Law and History Review•2025

In modern jurisprudence, it is recognized that courts will engage in arbitration, often under the rubric of Alternative Dispute Resolution. 1 Recourse to arbitration further back in the English past has often been perceived as extra-legal, taking place outside the system of courts, and sometimes intended specifically to avoid those courts. This research has concentrated on the avoidance of secular courts, in particular the king’s courts and commo…

  • The Politics of Diffuse Authority in an Early Modern Small Town

    Open Access•Dave Postles•ARTICLE•Journal of History•2010

Although more attention has recently been directed to English small towns, particularly in the early modern era, the number of intensive studies of this urban phenomenon remains small. Some general observations have been made about the political structure of these places, but the processes of those politics have not been examined in detail. Open Access•Dave Postles•ARTICLE•Journal of Historical Sociology•2005•Cited by: 3

Whilst historians' perceptions of the social organization of early-modern England have recently been dichotomized - perceived from either national or local levels - both interpretations rely on sources that are inherently very rhetorical in their representation of self and others. • The market place as space in early modern England

    Dave Postles•ARTICLE•Social History•2004•Cited by: 4•References: 8

The reinsertion of space into critical theory (Soja, LeFebvre) has stimulated some historians to reconsider space in its historical contexts. Exactly how one elucidates spatial organization-as represented space or as space produced by social action and practice-continues to exercise our minds. What we can be more certain about is that significant spaces existed which were, and were regarded by contemporaries, as public and open and that these spa…

  • Penance and the Market Place

    Open Access•Dave Postles•ARTICLE•The Journal of Ecclesiastical…•2003•Cited by: 2

During the later Middle Ages the ecclesiastical jurisdiction generally abandoned ritual humiliation in the market place as an integral part of penance imposed by sentence in its courts, although intermittently this punishment continued into the early sixteenth century. In the early decades of the ecclesia anglicana of Elizabeth, however, several jurisdictions reintroduced shaming in the market place as a consistent part of a disciplinary regime. …
