  • Capitalism Contested

Romain Huret, Nelson Lichtenstein et al.•EDITOR•BOOK•Capitalism Contested•2021

Arguing the New Deal order is a product of a particular set of political institutions, social movements, ideological propensities, and legislative initiatives, Capitalism Contested offers an analysis of the degree to which that order persists and the ways in which it has been transcended or overthrown.

Over the last decade populism has emerged as a frequently key notion when analyzing political and social evolutions in a large number of European and American countries. Its usage, however, is on the whole negative in that more often than not, it designates a direct appeal to the people based on the resentment of elites and/or other social groups while at the same time advocating a ragbag of so-called “simple” and demagogical measures. It is a no…

  • Framing the history of a social norm

  • Audra Jennings. Out of the Horrors of War

    Jean-Christian Vinel•ARTICLE•The American Historical Review•2018

From 1933 to 1945, the U.S. was led by a president who had contracted polio and yet managed to steer the country through its worst economic crisis and build a modern state around the politics of security. However, as Audra Jennings reminds us in the rich and important book Out of the Horrors of War, Americans with disabilities were actually left out of the New Deal welfare state, which mostly protected male workers employed full time. While the 1…

    Jean-Christian Vinel•ARTICLE•The American Historical Review•2016

Deftly straddling the fence between labor and civil rights history, Sophia Z. Lee’s The Workplace Constitution from the New Deal to the New Right is a superb and compelling account of the long-running quest for constitutional rights in the workplace since the 1930s. Relying on extensive archival research, Lee offers two intertwined legal stories that enrich but also complicate our vision of twentieth-century political history. The first one depic…

  • Christopher Tomlins' The State and the Unions today

    Jean-Christian Vinel•ARTICLE•Labor History•2013•References: 19

The thrust of this article is to review the evolution of the historiography of American labor law since the publication of Christopher Tomlins' widely celebrated The State and the Unions (1985). More than an isolated effort, Tomlins' critique of New Deal labor law was part of a broader analytical paradigm which should be called the ‘critical synthesis’. Dominating the field until the mid-1990s, the critical synthesis owed a part of its success to…

  • Un fossile pris dans l'ambre

    Jean-Christian Vinel•ARTICLE•Revue française d’études…•2007

This article analyses the legal construction of work in contemporary America by focusing on the ever-narrowing statutory definition of the legal concept of ?employee?. Through a study of the cases NLRB v. Health Care, (1994), and St Joseph News Press, (2005) this article shows how the concepts of ?independent contractor? and ?supervisor? are used in labor law to deconstruct the wage relationship and thus create a ?post-industrial society

  • The Old Has Been Dying and the New Is Yet to Be Born

    Jean-Christian Vinel•ARTICLE•Labor History•2007•References: 7

The thrust of this article is to put the current debate over the legal definition of ‘employee’ into historical perspective. By moving towards a socio-legal history of the ‘employee,’ this article seeks to show that like other legal constructs, the term ‘employee’ is the product of long decades of contested efforts to shape the legal construction of society. By ‘deconstructing’ the employee this analysis lays bare the assumptions that have underw…

  • The Other Side of Industrial Pluralism

    Jean-Christian Vinel•ARTICLE•Labor History•2007•Cited by: 2•References: 11

Since the 1980s historians and legal scholars have produced a criticism of industrial pluralism—the philosophy that dominated the theory and practice of labor relations from the 1940s to the 1970s—that has been so sharp and influential that it has laid to rest the mainstream liberal analysis of the Wagner Act developed by Irving Bernstein. The thrust of this article is to argue that in spite of its contribution to our understanding of the limits …

  • La naissance de la liberté syndicale aux états-unis

    Open Access•Jean-Christian Vinel•ARTICLE•Cahiers d’histoire Revue…•2006

  • Adarand v. Peña et l’affirmative action

    Vincent Michelot, Jean-Christian Vinel•ARTICLE•Revue française d’études…•1999

When Adarand v. Pena was handed down in June of 1995, many were the observers who remarked that the Supreme Court had dealt a mortal blow to affirmative action by submitting even federal programs and not just state ones to «strict scrutiny». Three years later, affirmative action programs have not been systematically dismantled and paradoxically, to some degree, they have found their legitimacy reinforced by the strong challenge from the Court. Th…
