  • A wilderness of monkeys

    Open Access•William P Macneil•ARTICLE•Law and Humanities•2025

I would not have given it for a wilderness of monkeys': so, says The Merchant of Venice's Shylock, referencing the ring gifted to him by his late wife, Leah, now stolen by his errant daughter, Jessica. An odd pronouncement for a character often read as an exemplar of exchange values for whom everyone and everything has its price.Excepting, of course, Leah's 'turquoise'.The implied use value of which repositions Shakespeare's most uncomfortable ste…

  • Lacanian ink and leather ‘down under’

    William P Macneil•ARTICLE•Griffith Law Review•2017

Throughout 2013, the then Queensland Government passed an increasingly bizarre series of legislative acts aimed, specifically, at largely Gold Coast based ‘bikies’; that is, local motorcycle club members long notorious for their links with drug traffickers, prostitution rings and organised crime. Consisting of the Criminal Law (Criminal Organisation Disruption) Amendment Act 2013 (Qld), the Tattoo Parlours Act 2013 (Qld), and the hilariously moni…

  • Brokeback’s Bareback

    Open Access•William P Macneil•ARTICLE•Law/text/culture•2015

One evening, almost a decade ago, at a smart dinner party held in Northcote, an inner suburb of Melbourne, the utterly fabulous and now, sadly, late Penny Pether turned to me after some discussion of the then recent American gay rights decision, the Supreme Court’s landmark Lawrence v Texas, and suggested, with her customary forthrightness that I should write about the case within the context of a film that both of us had only lately seen (her, o…

  • Precrime Never Pays! ‘Law and Economics’ in Minority Report

    William P Macneil•ARTICLE•Continuum•2005•Cited by: 3•References: 3

This paper examines the notion of "precrime" as articulated in the most recent Philip K. Dick film treatment (and Tom Cruise vehicle) Minority Report. I will situate precrime within a jurisprudential tradition concerned with prediction. The jurisprudence I look to, however, is not so much Holmes' celebrated 19th century realism (with its focus on "the predictive theory of the law") as its contemporary equivalent, Law and Economics. I will argue t…

  • The Monstrous Body Of The Law

    William P Macneil•ARTICLE•Australian Feminist Law Journal•1999•References: 2

The principal claim of this article is uncontroversial: that Romanticism reinvents rights. But what distinguishes this article's claim from that of countless others is that this rich and strange alchemy of reinvention stems not from that 'most wanted' of usual suspects, Rousseau (and behind him, Montesquieu,Voltaire and d' Alembert; and in the anglophone world, Locke and Hobbes). Rather this article locates rights' source elsewhere, in an alterna…

  • John Austin or Jane Austen

    Open Access•William P Macneil, W MacNeil•ARTICLE•Law/text/culture•1998

It used to be a truth universally acknowledged that the novels of Jane Austen were narratives in want of context. The Napoleonic Wars, industrialisation and the French Revolution: in fact, all the great and heroic events of the period are conspicuous by their absence in the 'little bit (two Inches wide) of ivory' upon which dear Jane worked with 'so Fine a brush'. Post-colonial critics, however, have sensitised readers to the traces of context on…
