Hans Kelsen on Constitutional Democracy
This volume challenges conventional interpretations by demonstrating that Hans Kelsen was far from being a purely formalist thinker. Instead, it highlights his profound and enduring engagement with the threats facing constitutional democracies. The political and institutional upheavals of interwar Europe significantly influenced Kelsen's evolving vision of democracy, as this volume shows. His contributions to twentieth-century democratic theory i…
Carl Schmitt's Multifaceted Rejection of Political Compromises
Carl Schmitt's constant denunciation of political compromises has received little attention. This omission is damaging in two ways. On the one hand, it misses a central aspect of Schmitt's political thought. On the other, it deprives those interested in discourses challenging the legitimacy of compromise in democracy of a valuable source. In this article, I systematize Schmitt's multifaceted grievances to compromises, especially as expressed in t…
Why do populists scorn compromises (and how do they live with them)
Both political theorists and scholars working on populism with an ideational approach have frequently noted that populists are averse to compromise. However, the negative relationship between populism and compromise has not been analyzed in detail. In this paper, we offer a comprehensive account of the reasons behind this oft-repeated conflict between populist narratives and the practice of compromise, disentangling the various dimensions of such…
Against compromise in democracy? A plea for a fine‐grained assessment
This paper disentangles the multiple facets of the ambivalent evaluation of compromise in politics. It identifies five main objections against compromises and their rebuttals. The first two objections are classic, and they both appeal to adherence to values, in terms of either their inviolability or their consistency. Another objection asserts the irreducibility of conflicts, and it is driven by hostility to a conception of politics that favors m…
Compromises in Democracy
Rehabilitating political parties
This paper focuses on Hans Kelsen’s reflections on political parties. During the interwar period, Kelsen participated in a controversy over whether political parties were a necessary part of the democratic process. The debate forced Kelsen to produce a defence of political parties to emphasise their functionality and define their place in his particular definition of democracy. This contribution considers the following aspects. First, the reasons…
Transparency
There is growing enthusiasm for transparency in public affairs. Discourses idealising the value of transparency are part of the rhetoric of advocates of ‘good governance’. However, there is little discussion of the justifications for transparency. The view that transparency underpins legitimacy is similar to that of the advocates for ‘publicity’ in the initial era of representative government, when transparency (or publicity) became a crucial iss…
On political theology
This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from tran…
