Reclaiming Justice: Islamic Feminism, Patriarchal Law, and Popular Revolt in Iran
The Challenges of Islamic Feminism
By the early 1990s there were clear signs of the emergence of a new gender discourse that came to be labelled ‘Islamic feminism’. In this paper, I first set this new discourse against the backdrop of the global and local politics of Islam and gender in the latter part of the 20th century. Then I introduce the work of feminist scholar-activists who argue for equality and justice from inside the Muslim tradition, outline how they seek to change the…

Gender and Equality in Muslim Family Law: Justice and Ethics in the Islamic Legal Tradition
Gender equality is a modern ideal, which has only recently, with the expansion of human rights and feminist discourses, become inherent to generally accepted conceptions of justice. In Islam, as in other religious traditions, the idea of equality between men and women was neither central to notions of justice nor part of the juristic landscape, and Muslim jurists did not begin to address it until the twentieth century. The personal status of Musl…
Beyond ‘Islam’ vs ‘Feminism’
Islamic feminism has gained currency since the 1990s and has become the label for a new brand of feminist scholarship and activism that is associated with Islam. But this article argues that the composite term ‘Islamic feminism’ has become so loaded with disputed meanings and implications, so enmeshed in local and global political struggles, that it is no longer useful in any kind of descriptive or analytical sense. I reflect on the term in the l…
The Politics and Hermeneutics of Hijab in Iran: From Confinement to Choice
Hijab covering of a Muslim woman's body is the most visible Islamic mandate. For a century it has been a major site of ideological struggle between traditionalism and modernity, and a yardstick for measuring the emancipation or repression of Muslim women. In recent decades hijab has become an arena where Islamist and secular feminist rhetoric have clashed. For Islamists, hijab represents their distinct identity and their claim to religious authen…

Islam and Democracy in Iran: Eshkevari and the Quest for Reform
In today s world all eyes are on Iran, which has grappled with an experiment that has had a massive global impact. For some, the Iranian Revolution of 1978-79 was the triumph of a modern, political Islam, heralding Muslim justice and economic prosperity. Others, including many of the original revolutionaries, saw religious fanatics attempting to roll back time by creating a despotic theocracy. Either way, the Iranian Revolution changed the Muslim…

Islam and Gender: The Religious Debate in Contemporary Iran
Following the Islamic Revolution of 1979 and the re-introduction of Sharica law relating to gender and the family, women's rights in Iran suffered a major setback. However, as the implementers of the law have faced the social realities of women's lives and aspirations, positive changes have gradually come about. Here Ziba Mir-Hosseini takes us to the heart of the growing debates concerning the ways in which justice for women should be achieved. T…

Inner Truth and Outer History: The Two Worlds of the Ahl-i Haqq of Kurdistan
A principal belief of the Ahl-i Haqq, an esoteric sect centered in Iranian Kurdistan, is that the Divine Essence has successive manifestations in human form. The Ahl-i Haqq religious universe comprises two distinct yet interrelated worlds: the inner world ( ʿālam-i bāṭin ) and the outer world ( ʿālam -i ẓāhir ), each with its own order and its own rules. We as ordinary human beings are aware of the order of the outer world, but our life is govern…
Marriage on trial: A study of Islamic family law : Iran and Morocco compared
"This book looks at how fiqh, Islamic family law, is interpreted and administered in two Muslim countries. It studies the complex relationship between the classical textbooks and modern codes of personal status law which in principle are based on them, but which in fact diverge from them both in substantive law and in methods of procedure and judgment. Based on extensive fieldwork in the courts and outside, it focuses on the dynamics of marriage …

Some aspects of changing marriage in rural Iran: The case of Kalardasht, a district in northern provinces
This paper examines the impact of the availability of wage labor on some aspects of marriage in Kalardast a rural area in northern Iran. It demonstrates how and to what extent traditional ceremonies and the system of transactions at marriage have been modified in recent years under the influence of a cash economy primarily as a result of the ability of young men to provide for their marriage and thus free themselves from their fathers households.…
Some Aspects of Changing Economy in Rural Iran: The Case of Kalardasht, a District in the Caspian Provinces

First, it is offered as a contribution to the economic ethnography of Iran. Second, it examines the process of continuity and change in the economic structure of rural Iran. Changes in rural communities as a result of transitions in the broader society have attracted much attention in recent years. Here…
Impact of Wage Labour on Household Fission in Rural Iran
The paper examines the impact of wage labour on the development cycles of households in four villages in Kalar- dasht, northern Iran. It is based on field work carried out in 1977 and 1978. One of the villages, affected by the expansion of tourism and the extension of state activity, experienced dramatic change. The other three, more isolated, did not. The analyses show: first, that although there exists a common set of ideals in relation to fami…
