Distinguishing and Reinterpreting in the Reason Model of Precedent
Courts that wish to avoid the effect of a binding precedent sometimes do so by reinterpreting the precedent so that its application depends on underlying facts of the case that were not invoked by the precedent court in the formulation of their reasons for decision. This article considers the implications of this practice, which I call “restrictive reinterpretation,” for the popular reason model of precedential constraint. The practice of restric…

Formalizing Reasons, Oughts, and Requirements
Reasons-based accounts of our normative conclusions face difficulties in distinguishing between what ought to be done and what is required. This article addresses this problem from a formal perspective. I introduce a rudimentary formalization of a reasons-based account and demonstrate that that the model faces difficulties in accounting for the distinction between oughts and requirements. I briefly critique attempts to distinguish between oughts …

Contextualizing an Iron Age IIA Hoard of Astragali from Tel Abel Beth Maacah, Israel
Astragali, the knuckle or ankle bones of mammals, have been collected, used and modified by humans in different parts of the world for millennia. Large hoards dating from Iron Age IIA (tenth–ninth centuries BC) are attested at a number of sites in the southern Levant, and a recently discovered hoard of 406 astragali at Tel Abel Beth Maacah in northern Israel presents an opportunity to investigate this phenomenon, shedding light on the function of…
Protected Reasons and Precedential Constraint
According to the prioritized reason model of precedent, precedential constraint is explained in terms of the need for decision-makers to reconcile their decisions with a settled priority order extracted from past cases. The prioritized reason model of precedent departs from the view that common law rules comprise protected reasons for action. In this article I show that a model utilizing protected reasons and the prioritized reason model of prece…
Rights, Roles, and Interests
I argue that rights that protect our performance of roles are grounded in our interests in performing that role. Many of valuable roles are partly constituted by duties or obligations. Nonetheless these roles—even apparently burdensome roles—contribute to our interests. Once it is bestowed upon them, the role has special value to its bearer. Under certain conditions, the individual’s interest in performing their role is sufficient to ground right…
From a Fortified Canaanite City-State to "a City and a Mother" in Israel
Tel Abel Beth Maacah is a prominent site on the border of Israel, Syria, and Lebanon where it occupied a strategic geopolitical niche among ancient Canaanites, Israelites, Arameans, and Phoenicians. A survey and five seasons of excavation have revealed an occupation sequence ranging from EB II until modern times with peak occupation dating to MB IIB and Iron Age I–IIA. The robust continuity in settlement from the Late Bronze Age until Iron Age II…
