State-Sponsored Human Trafficking in Belarus
This article focuses on an issue that hitherto has received relatively little academic attention: state-sponsored or state-facilitated human trafficking. Some cases of this practice, such as governments forcing their citizens to pick cotton, are clear cut; some are more contested. This article uses the case study of Belarus to consider whether weaponizing migrants for political gains can amount to the crime of human trafficking. The issue came to…
Human Trafficking in Conflict
The non-punishment provision with regard to victims of trafficking
People are trafficked for a variety of exploitative purposes, ranging from sexual and labour exploitation to forced criminality, forced begging, and many other lucrative activities. Traffickers increasingly involve their victims in illicit activities, such as holding false documents, theft, pickpocketing, drug smuggling, drug dealing, cannabis cultivation and fraud. Prosecution and detention of victims have a serious detrimental impact on their p…
The European legal regime on trafficking in human beings
The law on THB in Europe co-exists with the Palermo Protocol but goes significantly further, both in terms of law enforcement and in victim protection and assistance. This chapter discusses the principal instruments on THB adopted by the Council of Europe and the European Union, the &s;hard law&s;, as it were. All EU Member States are parties to the Council of Europe Convention. Reference is made also to non-binding measures, including those adop…
Routledge Handbook of Human Trafficking
Trafficking in human beings (THB) has been described as modern slavery. It is a serious criminal activity that has significant ramifications for the human rights of the victims. It poses major challenges to the state, society and individual victims. THB is not a static given but a constantly changing concept depending on societal changes and opinions, economic situations and legal developments. THB occurs both transnationally and within countries…
Human Trafficking and the Emergence of the Non-Punishment Principle
The article outlines the emergence of the non-punishment principle with regard to victims of human trafficking: that people who commit offences in the course, or as a consequence, of being trafficked should not be held criminally accountable because they have been compelled to do so. It is argued that this principle is grounded in recognition of the human rights of trafficked people. The article traces the emergence of the principle in human righ…

The UNHCR's Guidelines on Human Trafficking
In April 2006 the UNHCR published Guidelines on the application of the Refugees Convention to people who have been trafficked. While there is little doubt that trafficked people are subjected to serious violations of their basic rights and interests, the applicability of the Convention is problematic because they do not fit easily into any of the categories recognised by the Convention as giving rise to an entitlement to refugee status. The Guide…
The Refugee in International Law
A lot has happened since the 2nd edition of Goodwin-Gill's famous work was published in 1996. The CSR51 reached its half-century, celebrated (acknowledged?) by Global Consultations and Convention Plus (or Convention Lite, as some called it). Subsidiary, or complementary, protection is now well established in many countries as a way of granting international protection to those who do not qualify for refugee status (or perhaps to avoid granting re…
Subsidiary Protection And Primary Rights
On 12 September 2001 the Commission of the European Communities published its Proposal for a Council Directive laying down minimum standards for the qualification and status of third country nationals and stateless persons as refugees, in accordance with the 1951 Convention relating to the status of refugees and the 1967 protocol, or as persons who otherwise need international protection 1 (Proposal)
