  • Insiders and Outsiders: The Role of Human Agents and Networks in System Change

    Open Access•Murray Forsyth, Anthea Roberts•ARTICLE•Regulation & Governance•2025•References: 22

This article focuses on the roles of insiders or outsiders in order to theorize the role that human agents play in systems change. It asks: (1) what strengths and weaknesses do insiders and outsiders have respectively as agents of change; and (2) what strategies are available to use these insights to increase, or to limit, the prospects of significant and lasting change? Drawing on an interdisciplinary range of scholarship, it develops a general …

  • Opportunities for peace and non violence in the Papua New Guinea Highlands

    Open Access•Murray Forsyth•ARTICLE•Journal of Aggression Conflict…•2024•References: 4

Purpose This paper aims to synthesise the literature addressing opportunities for intervention and peacemaking in the Highlands of Papua New Guinea (PNG). It shows that peacebuilding in PNG is actively practised in a variety of different forms and by a range of actors. It relies heavily on local champions and coalitions working together with “bits of the state” in inventive but, ultimately, highly vulnerable ways. It argues that the way forward i…

  • The state of contemporary intergroup conflict in the Papua New Guinea Highlands

    Open Access•Murray Forsyth•ARTICLE•Journal of Aggression Conflict…•2024•References: 6

Purpose This paper aims to discuss the scholarship over the past 30 years on what used to be called Melanesian warfare or “tribal fighting” and is termed in this paper “intergroup conflict” in the Highlands of Papua New Guinea. The paper categorises the drivers of intergroup conflict that make up the landscape for conflict in the Highlands. It starts with cultural factors and the understandings about conflict that have long been used to explain s…

  • Thinking incrementally about policy interventions on intimate partner violence in Papua New Guinea: Understanding ‘popcorn’ and ‘blanket’

Michelle Nayahamui Rooney, Murray Forsyth et al.•ARTICLE•Culture Health & Sexuality•2023

Papua New Guinea (PNG) has introduced laws and policies aimed at protecting women from intimate partner violence. This article examines how men who live in Lae, PNG, have made sense of and reacted to these laws and policies. Two evocative metaphors -'popcorn' and 'blanket' - emerge from our research. For 'popcorn', we see how the reforms created a chain reaction similar to that when popcorn is made. Using this metaphor, we analyse men's responses…

  • Street‐level bureaucrats in a relational state: The case of Bougainville

    Open Access•Gordon Peake, Murray Forsyth•ARTICLE•Public Administration and…•2022

We explore how street‐level bureaucrats (SLBs) as ‘agents of the state’ operate in circumstances where there is very little state, at least as state form is understood in the context in which street‐level bureaucracy theorising has developed. Using the example of post‐conflict Bougainville, we suggest SLBs actually construct the state through their wide‐flung and deep networks of relationality. We propose that SLBs in the majority world may be he…

  • A future agenda for environmental restorative justice

Murray Forsyth, Deborah Cleland et al.•ARTICLE•The International Journal of…•2021

A future agenda for environmental restorative justice? The challenges of developing meaningful environmental regulation to protect communities and the environment have never been greater. Environmental regulators are regularly criticised for failing to act hard and consistently, in turn leading to demands for harsher punishments and more rigorous enforcement. Whilst acknowledging the need for strong enforcement to address wantonly destructive pra…

  • Is now the time for restorative justice for survivors of sexual assault

Meredith Rossner, Murray Forsyth•ARTICLE•The International Journal of…•2021

It is almost a cliché to begin an article on sexual violence by noting the dreadful statistics about its global prevalence and frequency, the huge proportion of survivors that do not access the formal justice system, and the well-known justice gap resulting from failures of criminal justice systems in relation to such cases \n(Cossins, 2020; Lonsway & Archambault, 2012; Temkin & Krahé, 2008). And yet here we are. As each year passes, and the data…

  • Policing in a relational state: The case of sorcery accusation-related violence in Papua New Guinea

    Murray Forsyth•ARTICLE•Policing & Society•2021•Cited by: 3•References: 12

Sorcery accusation-related violence raises many profound policing challenges, especially in countries where police forces find themselves outnumbered and outgunned by mobs of perpetrators. Drawing on empirical evidence from a multi-year study into this phenomenon in Papua New Guinea reveals the ways in which police officer's relationality both enables and impedes the provision of policing and security in such contexts. Using this as a case study …

  • Liquid regulation: The (men's) business of women's water music

    Open Access•Murray Forsyth, Thomas Dick•ARTICLE•International Journal of Law in…•2021•Cited by: 1•References: 5

Complexity and uncertainty often animate the desire for regulatory approaches seeking to fix, limit and constrain. But what if, instead of doubling down on ‘solid’ regulation, we also make room for ‘liquid’ regulatory approaches? We interrogate this question through deep empirical analysis of the developing regulatory framework around a form of Melanesian cultural property known as water music. We argue that, although both solid and liquid regula…

  • Restorative nodes of governance in the Anthropocene: Iran's Kashaf River

    Open Access•John Braithwaite, Honeye Hojabrosadati et al.•ARTICLE•Law & Policy•2021•Cited by: 1•References: 21

This article describes an environmental crisis in Iran that is actually a multidimensional crisis of law and policy. The article explores the restorative nodal governance response to such polycentric problems by weaving together five related ideas originating from criminologist and regulatory scholar Clifford Shearing: nodal governance; regulatory culture as a storybook (rather than a rulebook); justice as a better future; networked discovery of …

  • Hybridity on the Ground in Peacebuilding and Development: Critical Conversations

J Wallis, Lia Kent et al.•BOOK•Hybridity on the Ground in…•2018

Hybridity on the Ground in Peacebuilding and Development engages with the possibilities and pitfalls of the increasingly popular notion of hybridity. The hybridity concept has been embraced by scholars and practitioners in response to the social and institutional complexities of peacebuilding and development practice. In particular, the concept appears well-suited to making

  • Kill All The Sorcerers: The Interconnections Between Sorcery, Violence, War and Peace in Bougainville

    Open Access•Murray Forsyth, Miranda Forsyth•ARTICLE•The British Journal of Criminology•2018•Cited by: 3•References: 7

This paper provides new insights into how violence in war structures peacetime violence by highlighting how war alters ontological positions or worldviews, such as those concerning the relevance of threat of harm through spiritual means. It presents a detailed case study of sorcery accusations and related violence before, during and after Bougainville’s decade long civil war. New empirical data are used to illustrate the mechanisms through which …

  • Using the concept of hybridity to guide social change through legal means

    Murray Forsyth, Miranda Forsyth•ARTICLE•Third World Thematics A TWQ Journal•2017•Cited by: 1•References: 25

This paper discusses the potential of the concept of hybridity to be used to guide or inform law reform or regulatory reform in legally plural contexts. It argues such an approach starts with the conception of multiple fluid legal orders that spill over into each other and at any one time have the potential to go in multiple different directions. Taking this understanding as a starting point leads to potentially useful ways to consider difficult …

Murray Forsyth, Miranda Forsyth et al.•ARTICLE•Third World Thematics A TWQ Journal•2017•Cited by: 2•References: 31

The concept of hybridity has been used in numerous ways by scholars across a range of disciplines to generate important analytical and methodological insights. Its most recent application in the social sciences has also attracted powerful critiques that have highlighted its limitations and challenged its continuing usage. This article, which introduces the collection on Critical Hybridity in Peacebuilding and Development, examines whether the val…

  • Making the case for a pluralistic approach to intellectual property regulation in developing countries

Murray Forsyth, Miranda Forsyth•ARTICLE•Queen Mary Journal of Intellectual…•2016

Many of the poorest and least developed countries in the world are currently experiencing pressure to adopt global intellectual property regimes in order to promote their socio-economic development. These regimes are claimed to be necessary to stimulate innovation, creativity and the transfusion of new knowledge. However, international organizations and developing agencies making such claims often overlook the existing local intellectual property…

  • Regulating Cultural Performances in Oceania: The Complicated Relationship between Law, Creativity and Cultural Property

Open Access•Murray Forsyth, Kalissa Alexeyeff•ARTICLE•Journal de la Société des…•2016•References: 4

This paper explores a number of tensions around claims of rights over various aspects of cultural performance with a particular focus on the Cook Islands. We discuss the historical context of these tensions and trace the way in which certain anxieties and agendas have led to demands for, and the realisation of, new laws over cultural performances, most particularly the Copyright Act 2013 and the Traditional Knowledge Act 2013. We then discuss how…

This paper analyses the significance of these events from both a political and legal perspective, in particular, considering the extent to which they were unprecedented and exceptional in terms of Vanuatu’s history. Certainly, the trial and convictio…

The most visible problems relating to these beliefs and practices are the violent exorcisms, banishment, torture, and killing inflicted upon those accused of practicing sorcery and witchcraft in many parts of the global South. Sorcery and witchcraft are also (once again) becoming a challenge for countries in the gl…

Murray Forsyth, Richard Eves•BOOK•Talking it Through•2015

Sorcery and witchcraft practices and beliefs are pervasive across Melanesia. They are in part created by, and give rise to, a wide variety of poor social and developmental outcomes. These include uneven economic development, low public health, lack of social cohesion, crime, fear and insecurity. A further very visible problem is the attacks on men and women who are accused of

The paper examines Hobbes's doctrine of representation and argues that implicit in this doctrine is the modern notion of the people as the constituent power of the state. Attention is focused on the progressive evolution of Hobbes's ideas about the multitude, the people, and the constitution of political unity, and on the connection between his doctrine of political representation and his concept of personality. The paper ends by assessing the co…

  • Hayek's Bizarre Liberalism: A Critique

    Open Access•Murray Forsyth•ARTICLE•Political Studies•1988•Cited by: 8

This paper questions the conventional view of F. A. Hayek as a reviver of ‘classical liberalism’. It argues that the foundation of Hayek's doctrine is a naturalist or physicalist conception of man which is at variance with the classic tenets of liberalism. It shows how Hayek's theory of society and of the abstract rules that ought to govern society are partly a continuation and partly a contradiction of his physicalist notion of man. The paper dr…

It also unpacks the different agendas b…
