The Consent Theory of Political Obligation
First published in 1987. The theory that political obligation and authority are derived from the consent of citizens is commonly accepted in the history of Western political thought. It is expressed in the famous assertion of the American Declaration of Independence that governments derive ‘their just powers from the consent of the governed’ and in the constitutions of some Western powers. A Liberal Theory of Secession
Separatism is a major contemporary socio-political problem and a basic but neglected problem of political philosophy. An attempt is made here to rescue the topic of secession from philosophical neglect and to demonstrate its theoretical importance by developing a liberal normative theory of secession. The claim is made that liberalism requires that secession be permitted if it is effectively desired by a territorially concentrated group and is mo…
Must secession be rebellion
Some constitutional theorists claim that secession is necessarily rebellion and that there cannot be a constitutional right to secession. I (1) try to show that these claims are implausible, (2) explore the non‐legal assumptions about the nature of the state and the citizen which make the acceptance or rejection of these legal claims plausible, (3) consider the desirability of incorporating a provision for secession in the constitution of liberal…
