  • Lost in translation

Sindiso Mnisi, Jeff Handmaker•ARTICLE•South African Journal on Human…•2026

This introductory article provides an overview of the special issue on how language influences conceptions of justice and rights in South Africa. Foregrounding indigenous languages reveals the limitations of English legal concepts, including cultural differences, semantic issues of translation, and the continuities of colonial legacies. Accordingly, our threefold objectives in producing this special issue were: firstly, to explore the dissonance …

  • O Lungo Drom

    Open Access•Jeff Handmaker, Sanne Taekema•ARTICLE•Journal of Human Rights Practice•2023•Cited by: 2•References: 11

Legal mobilization is a contested topic. There is little consensus among scholars regarding what legal mobilization is, let alone how it functions, particularly in relation to the separation or balance of powers doctrine, the latter which concerns the formal mandates of public actors and their interactions in relation to rule of law as a form of governance. We argue that the use of law by civic actors to advance social change should be distinguis…

  • Introduction to the legal mobilization special focus

    Open Access•Jeff Handmaker•ARTICLE•Journal of Human Rights Practice•2023•References: 7

For many of us who study, or practice legal mobilization, the image of a duck-rabbit can be regarded as a metaphor of the very different world views and vocabularies that legal scholars and legal practitioners as well as social scientists and social activists use in explaining and practising law-based advocacy. Conventional, siloed approaches by academics and practitioners alike are common, though hardly desirable. We feel that rather than ask wh…

  • Theorizing Local Migration Law and Governance

Open Access•Benjamin Perryman, Jeff Handmaker et al.•BOOK•Theorizing Local Migration Law…•2022

In many regions around the world, the governance of migration increasingly involves local authorities and actors. This edited volume introduces theoretical contributions that, departing from the 'local turn' in migration studies, highlight the distinct role that legal processes, debates, and instruments play in driving this development. Drawing on historical and contemporary case studies, it demonstrates how paying closer analytical attention to …

  • Confronting apartheid

Jeff Handmaker•ARTICLE•South African Journal on Human…•2020

This book by Professor John Dugard is both an autobiography as well as a critical legal history from a well-placed insider. As I have read it, the book’s first goal is to explain apartheid as an oppressive and illegitimate system of laws – what I would regard as lawfare – and their impact on society, whereas the second goal is to highlight civic, government and international responses to this, drawing on case studies from Namibia, South Africa an…

  • Mobilising International Law for 'Global Justice'

    Open Access•Barbara Oomen, J D Handmaker et al.•EDITOR•BOOK•Mobilising International Law for…•2018

Mobilising International Law for 'Global Justice' provides new insights into the dynamics between politics and international law and the roles played by state and civic actors in pursuing human rights, development, security and justice through mobilising international law at local and international levels. This includes attempts to hold states, corporations or individuals accountable for violations of international law. Second, this book examines…

  • Advocating Accountability

    Open Access•Jeff Handmaker•ARTICLE•Netherlands Quarterly of Human…•2007

This paper examines the roles and impact of civic initiatives in forming a refugee rights discourse and ushering in refugee policy in South Africa in compliance with its international obligations. Some inputs to this process have sought to ‘reformulate’ the law to fit political realities, while recent commentaries of the process have been limited to moralistic arguments supported by little more than legal rhetoric. Both miss the broader picture a…

  • Seeking Justice, Guaranteeing Protection and Ensuring Due Process

    Open Access•Jeff Handmaker•ARTICLE•Netherlands Quarterly of Human…•2003

Efforts to secure protection for refugees in the Netherlands are being undermined by over-enthusiastic use of the exclusion principle in refugee status determination procedures. Inappropriate use of the exclusion principle is tied to accelerated (albeit ineffective) efforts to secure justice for human rights violators. As this article argues, the tensions that arise are unacceptable, but can be appropriately addressed through a (re)commitment to …

  • Migration, Refugees, and Racism in South Africa

    Open Access•Jeff Handmaker, Jennifer Parsley•ARTICLE•Refuge Canada s Journal on Refuge•2001•Cited by: 6

The paper looks at South Africa’s complex history and policies of racism, social separation and control and the impact that this has had on the nature of migration and refugee policy. The paper argues that this legacy has resulted in policy and implementation that is highly racialized, coupled with a society expressing growing levels of xenophobia. Some causes and manifestations of xenophobia in South Africa are explored. It further examines how …

A policy designed to recognize former Mozambican refugees for the purposes of a repatriation program became the (awkward) basis of the asylum procedure up until April 2000. Criticized by some, a lively discussion raising often-contradictory views began in 1996, leading to a policy reform process culminating in the Refugees Act in December 1998. The Act only ca…

  • Who determines policy? Promoting the right of asylum in South Africa

    Jeff Handmaker•ARTICLE•International Journal of Refugee…•1999

South Africa has recently been spared the long-term, large-scale refugee movements seen by other countries on the continent, although its own external and internal history has seen it contribute to displacement in other countries, create refugees out of its own people, and face internal displacement as a result largely of political violence. In recent years, and in common with many other States, South Africa has had to deal with the question of h…
