The Work of Forgetting
This article uses inquiry into the medical subfield of industrial medicine in the early twentieth-century United States to build on recent work in the history of occupational safety and health and the broader history of injury and harm in working-class people’s lives. It focuses especially on Lori Flores’s concept of “amnesic landscapes,” arguing that the concept can do much to advance the integration of the history of occupational hazards into l…
Labor History and Class Violence
The year 2025 marks the 120th anniversary of Lochner v. New York , a 1905 U.S. Supreme Court decision striking down legislative limits on work hours in the baking industry. U.S. scholars generally agree this decision harmed workers and was a setback to the labor movement in the United States. The essay borrows from some of the historian E.P. Marxist Theories of Law Past and Present
Capitalist society seems particularly disorderly of late, a disorder contributing to the beginnings of what we hope will be a renewal of Marxist legal scholarship. This essay reviews some key developments in Marxist analysis of law from the 1970s to the present. Over all, our essay traces a back and forth between Marxists' emphasis on theoretical inquiry on the one hand and empirical and historical work inquiry on the other. We argue that Christo…
Incentivizing Safety and Discrimination
This article takes criticisms of employment discrimination in the aftermath of the creation of workmen’s compensation legislation as a point of entry for arguing that compensation laws created new incentives for employment discrimination. Compensation laws turned the costs of employees’ workplace accidents into a risk that many employers sought to manage by screening job applicants in a manner analogous to how insurance companies screened policy …
Transatlantic Slave Trade
Slavery and migration can be considered as parallel or as overlapping areas of inquiry. Migration historians have studied migrants who moved with varying degrees of freedom and compulsion – convicts, indentured servants, refugees, free laborers – as well as structures of mobility management including immigration law and border control. Slavery historians have considered slavery as a system of social status, a system of property, and a system of l…
