  • What's Old Is New Again: Political Science, Law, and Constitutional Meaning

    Open Access•Robert J Spitzer•ARTICLE•PS Political Science & Politics•2013•References: 7

Political science and law intersect not only in the political world, but as disciplines. This is as it should be, and for two important reasons: disciplinary history and content. As Fisher (2009, 798) notes, the first political science graduate program, founded in 1880, studied “history, law, and philosophy.” The American Political Science Association, founded in 1903, defined itself in terms of six distinct areas of study, five of which—comparat…

    Open Access•Robert J Spitzer•ARTICLE•Presidential Studies Quarterly•2012•Cited by: 1•References: 3

Recent presidents have carved out a presidential power by asserted constitutional right allegedly adhering to the presidency in the form of the so‐called protective return pocket veto, by which presidents claim to pocket veto a bill—a circumstance where, by definition, bill return to Congress is not possible—yet proceed to do the impossible by returning the bill to Congress. This obscure yet portentous power grab (1) arose, ironically, from adver…

    Open Access•Robert J Spitzer•ARTICLE•Presidential Studies Quarterly•2008•Cited by: 2•References: 5

Legal training is well suited to prepare lawyers for the study and practice of law in the advocacy‐based legal system. But when lawyers as academics enter the realm of constitutional law, legal training offers poor preparation for academic analysis. Worse, the vast realm of legal publishing—law reviews—is run by students who do not rely on peer review, unlike every other academic discipline. The result of these two factors is great potential for …

  • The Law: The “Protective Return” Pocket Veto: Presidential Aggrandizement of Constitutional Power

    Open Access•Robert J Spitzer•ARTICLE•Presidential Studies Quarterly•2001•Cited by: 1•References: 4

This article discusses the all‐but‐unknown practice of recent presidents to exercise a so‐called “protective return” veto, whereby presidents simultaneously exercise both a return veto and a pocket veto for individual bills. Defended by recent administrations as a defense of the existing pocket veto power, this article argues that it is in fact an attempt to create a practical absolute veto, a power rejected by the Constitution's founders. Veto h…

The Culprit One of the more revealing and less pedantic kiss-and-tell books to come out of a presidential administration was David Stockman's (1987) The Triumph of Politics . In it…
