  • Class, Indigenous peoples and race - reinforcing equality and dignity

Geraldine Van Bueren•ARTICLE•Journal of Australian indigenous…•2025

There is an absence of the intersection between class and Indigenous nations, and this is compounded by an absence of the acknowledgement of the intersection between rurality and class. It is as if class, or particularly the working and poorer classes, are only accepted as being urban and of the more recent occupants of lands. This article looks at the major implications for overcoming the intersection between class and indigenous discrimination by…

This article discusses the author's concept of multigenerational citizenship, arguing that for citizenship to be relevant for children, there needs to be a more flexible and relational approach to citizenship. The article exa…

Open Access•Geraldine Van Bueren•CHAPTER•Political Economy of New Slavery•2004

The purpose of any type of reparations for past wrongs, is the restoration of dignity: the dignity of survivors, the dignity of the memory of the dead and the dignity achieved by making restitution for past wrongs. The very act of reparation is to acknowledge respect. Reparations for consistent patterns of historic abuses, including slavery, should be discussed with this ethos and the building of a global community framework in mind. Respect is t…

  • Alleviating Poverty through the Constitutional Court

Geraldine Van Bueren•ARTICLE•South African Journal on Human…•1999

Constitutional human rights litigation has the potential to play an important role within a broader eradication of poverty strategy but new litigation tools need to be developed which are more appropriate for litigating on economic and social rights, including human rights budgets and indicators. New approaches also have to be adopted including identifying the minimum core of the government's obligations in relation to each right and an appropria…

    Open Access•Geraldine Van Bueren•ARTICLE•Law & Policy•1995•References: 16

Children are rarely perceived as torture victims, although they may be easier targets. International inertia is compounded as not only torture, but also ‘other cruel, inhuman or degrading treatment or punishment’ is prohibited. Some of these occur in the private sphere, which traditionalists erroneously assume outside of international human rights law. Children may also be unprotected because they suffer from trauma in different ways from adults.…
