I denne artikkelen present…
Unconscious or for Other Reasons Incapable of Resisting”: (Un)Protected Sexual Assault Under Norwegian Criminal Law
According to Norwegian legislation, "sexual activity with a person who is unconscious or for other reasons incapable of resisting the act" constitutes sexual assault. Our task in this article is to identify the kind of sexual harms that are (un)protected by this paragraph and to discuss the boundaries of rape that are set by legal practice. We do so through a systematic analysis of all verdicts on incapacity and sexual assault at appellate court …
Violent re-presentations: Reflections on the ethics of re-presentation in violence research
How comfortable a read can research that has violence at its core become, before the distance created by language becomes an ethical-and analytical-challenge in its own right? In this article, I explore and reflect on ethical dilemmas of re-presenting violent experiences, following the traction of my research. The article addresses a challenge that scholars are faced with as we conduct, write up, and communicate research on issues to do with viol…
Narrative expressivism: A criminological approach to the expressive function of international criminal justice
In response to recent demands to make use of international criminal justice institutions’ archives for social scientific research, this article develops a theoretical approach to international criminal justice called narrative expressivism. Narrative expressivism considers criminal justice as a potent source of information about past crimes – yet also, as a site that impacts on present and future societal understandings of mass violence, promotin…
End Impunity! Reducing Conflict-Related Sexual Violence to a Problem of Law
Whilst sexual violence has been an offence associated both with war- and peacetime throughout history, its rise to the tables where international peace and security are negotiated, represents a significant shift. This article continues the scholarly conversation about conflict-related sexual violence and its emergence as a "hot topic" on academic, political, and activist agendas. Specifically, we ask how and why criminal law constitutes the ultim…
Re-presentations of Defendant Perpetrators in Sexual War Violence Cases Before International and Military Criminal Courts: Table 1
The empirical material produced by proceedings at International Criminal Tribunals and selected US courts-martial comprise one of few available sources on the lives and experiences of individual perpetrators of sexual war violence. In this article I explore primary court actors’ narratives about defendant perpetrators and identify and discuss how aetiology is understood, re-presented and constructed from the individual actor perspective that crim…
