Allocation of scarce life-saving medical resources
In this paper, we address the moral justification problem concerning the use of age as a criterion for the allocation of scarce life-saving medical resources. We present and discuss four justifications that stand out in philosophical literature: efficiency, sufficiency, egalitarian, and prioritarian. We aim to demonstrate that all these justifications are unsatisfactory since they entail counterintuitive implications in cases involving fetuses an…
Feminist reformulations of human rights
For feminist philosophers it is important to consider how the language of human rights can be used to support women’s issues and how well it is established in political institutions. However, they suggest that human rights should be reformulated and supplemented with other ethical frameworks to ensure that injustices to women are not neglected. The aim of this paper is to argue that Nussbaum’s capability approach can take into account feminists’ …
The human right to liberty and Brazilian abortion practices
The aim of this paper is to justify women’s right to abortion in the first trimester of pregnancy. Considering human rights as the protection of our normative agency or personhood, this paper will argue that human rights cannot be extended to human embryos and foetuses. In the first trimester of pregnancy, the moral status of the foetus is not sufficient to overcome the woman’s right to the freedom to control her own body. There may be, however, …
Kant’s concept of indirect duties and environmental ethics
The aim of this paper is to assess whether Kant’s moral theory is suitable to deal with our obligations to take care of nonhuman animals and the environment. Kant’s ethics distinguishes persons, that is, rational beings with unconditional values who are considered as ends in themselves, from things, which have only relative worth. In relation to nature as a whole and to nonrational beings, Kant argues that we have only indirect duties or duties w…
