  • Using court documents as data

    Open Access•Anya Degenshein, C A Leslie•ARTICLE•Law & Society Review•2025•Cited by: 2•References: 85

Though the use of court documents as data is widespread within US sociolegal scholarship, their use remains surprisingly undertheorized as a methodological practice. This article, therefore, asks, what differentiates court materials from other forms of documentary data, and how do these attributes impact claimsmaking in law and society scholarship? Drawing on varied empirical examples from existing scholarship, we uncover five distinctive attribu…

  • Finding the criminal within

    Anya Degenshein•ARTICLE•Information Communication & Society•2024

How are our digital footprints used and interpreted in the courts? To answer this question, I analyze over 2,500 pages of trial transcripts for a keystone case in the use of digital surveillance at trial. Much like its use on both the front- and back-end of the criminal justice system, I find that it is used to link past actions to future ones. However, unlike previous research, I show that these conclusions are not drawn from actuarial modeling.…

  • The conceptual limits of risk governance in terrorism prevention

    Open Access•Anya Degenshein•ARTICLE•Theoretical Criminology•2024•Cited by: 3•References: 3

Risk theories have dominated research on policing and punishment for the past 30 years, including a growing interest in crime prevention. Drawing on excerpts from court documents of 351 counterterrorism stings, an empirical exemplar in contemporary crime prevention, I demonstrate that these cases both defy the logics of actuarial risk governance and exceed the logics of precautionary risk governance in three ways: (1) who they target; (2) how the…

  • Ruptured alliances

    Open Access•Anya Degenshein•ARTICLE•Punishment & Society•2022•Cited by: 1•References: 7

Using a combination of FOIA-requested legislative committee hearings and in-depth interviews, this manuscript investigates the work of Illinois prosecutorial lobbyists in state-level crime policy during a time of penal reform. I find that prosecutorial lobbyists are a regular and influential presence in policy discussions, advocating primarily for 'law and order' policies that expand prosecutorial discretion, even following the Great Recession. I…
