Reframing Secularist Premises
Recent decades have witnessed a significant increase in scholarly attention to the subject of secularism. This body of work, theoretical and normative in nature, rarely addresses ethnographic data and the lived experiences of situated agents. Starting with a review of three major theoretical approaches to the study of secularism (i.e., the writings of the 19 th century Freethinker George Jacob Holyoake, the research of scholars who work in post-F…
Muslim Marriage in Western Courts
Headscarf and burqa controversies at the crossroad of politics, society and law
I also acknowledge the financial support of the Law Foundation of Ontario.Notes1. In this Introduction, I use for brevity's sake the word 'burqa' to refer to the various face-covering Islamic veils such as the niqab, the burqa and the chador, in accordance with frequent uses of the term in media and political debates.2. R. v. N.S., [2012] 3 S.C.R. 726. The Supreme Court purported to balance the religious freedom of N.S., a Muslim woman contesting…

(2012). Halacha, The ‘Jewish State’ and The Canadian Agunah: Comparative Law at the Intersection of Religious and Secular Orders. The Journal of Legal Pluralism and Unofficial Law: Vol. 44, No. 65, pp. 165-204
Calculating claims
This article presents an empirical study of Jewish and Muslim women who go through divorce in Canada, drawing on a ‘left law and economics’ methodology. Religious law and family law have long been considered outside the market and, as a result, are more rarely accounted for in the law and economics literature. According to dominant narratives, religious family law is experienced by women either as an exceptional form of oppression or as a form of…
Muslim Marriage in Western Courts
This book describes and analyses the notion of Mahr, the Muslim custom whereby the groom has to give a gift to the bride in consideration of the marriage. It explores how Western courts, specifically in Canada, the United States, France, and Germany, have approached and interpreted Mahr. Although the outcomes of the cases provide an illustrative framework for the book, the focus is broader than simply the adjudicative endeavours. The work explore…
