Bibliographie: Lauth, Hans-Joachim: Einleitung: Die Relevanz des Rechts, Rechtsstaats und der Verfassung. Zum Tode von Michael Becker (1958–2024), ZPTh – Zeitschrift für Politische Theorie, 2-2025, S. 345-352
Local Self‐Governance and Weak Statehood: A Convincing Liaison
This thematic issue addresses the relationship between local self-governance and the state. Self-governance is understood as the rules that emerge in the local social and spatial context. Local self-governance of individual local groups, actors, communities, and their social and institutional arrangements are considered. From this situated collective entanglement, the interactions and relations with state authorities are analysed in the various c…
Different types of deficient democracies: Reassessing the relevance of diminished subtypes
Typologies are widely applied tools in democracy research. There are two prominent ways of constructing subtypes of democracies: whereas the classical approach adds traits successively to gain regular subtypes, the radial approach subtracts traits from the concept to obtain diminished subtypes. Conceptually, we argue that radial types have distinct advantages over the classical approach. Diminished subtypes can deal with complex concepts with mul…
Local Self-Governance and Varieties of Statehood: Tensions and Cooperation
Estado De Direito E Instituições Informais
The present work addresses the legal systems that exist outside the constitutional order, through the existence of rechtsstaat and informal legal systems in the rule of law. Thus, the question is: what is the relationship between the formal systems and the right? To this do so, the law and legal systems, the concept of state and the formal systems are analyzed first. The study of the relationship between the rule of law and the formal institution…
Political Trade-Offs: Democracy and Governance in a Changing World
The investigation of trade-offs in political science receives only limited attention, although many scholars acknowledge the importance of trade-offs across a variety of different areas. A systematic and comprehensive examination of the topic is missing. This thematic issue of Politics and Governance sheds light on this research deficit by providing a holistic but also an integrative view on trade-offs in the political realm for the first time. R…
Making Trade-Offs Visible: Theoretical and Methodological Considerations about the Relationship between Dimensions and Institutions of Democracy and Empirical Findings
Whereas the measurement of the quality of democracy focused on the rough differentiation of democracies and autocracies in the beginning (e.g. Vanhanen, Polity, Freedom House), the focal point of newer instruments is the assessment of the quality of established democracies. In this context, tensions resp. trade-offs between dimensions of democracy are discussed as well (e.g. Democracy Barometer, Varieties of Democracy). However, these approaches …

The internal relationships of the dimensions of democracy: The relevance of trade-offs for measuring the quality of democracy
Definitions of democracy almost always refer to dimensions. An important question arises about the internal relationships between them. This article presents arguments in favor of the ideas of mutual reinforcement as well as of intrinsic tensions or trade-offs. A well-known example of these kinds of trade-offs is the complex relationship between liberty and equality. Surprisingly, trade-offs are not reported when measuring democracy. The article …

Heterogeneity and Democracy Reconsidered
The relationship between heterogeneity and democracy is complex and manifoldly interwoven. The increasing heterogenisation of democratic societies seems to be the most apparent internal challenge to modern democracies, manifesting at least in two dimensions: culturally as ethnic and religious heterogenisation and structurally as socioeconomic and social heterogenisation. Following this distinction, democratic societies today are particularly faci…
Quality Criteria for Democracy. Why Responsiveness is not the Key
Responsiveness, a basic principle of democracy, its relevance as well as our understanding of it are examined and widely discussed. There are two reasons for this choice. Firstly, the quality of democracy and with it the regression of democracy are often linked to responsiveness in public debates. Secondly, by such examination, we are considering crucial definitions of democracy, which have given direction to research into Comparative Democracy (…

Informal Institutions and Democracy
Informal institutions have grown in relevance for the analysis of new 'third wave' democracies. The research strategy receives its impetus from the debate on neo‐institutionalism theory, which offers a productive perspective for structuring the field of analysis. This article explains the distinguishing factors between formal and informal institutions. It addresses five basic types of informal institutions, examines the ways in which they functio…

Putting Deficient Rechtsstaat on the Research Agenda: Reflections on Diminished Subtypes
This article proposes a typology of diminished subtypes of Rechtsstaat. Building on a historical overview of the different constitutional traditions in the United States, Great Britain, and Germany, an ideal type of Rechtsstaat is identified. This definition provides the foundation for the creation of subtypes, which are structured into two categories. First, four diminished subtypes of Rechtsstaat are defined: inconsistent, arbitrary, partly-imp…
