  • The Progressive Development of International Law on the Return of Stolen Assets

    Open Access•Cecily Rose•ARTICLE•European Journal of International…•2024

The return of stolen assets represents a ‘fundamental principle’ of the United Nations Convention against Corruption (UNCAC). The convention’s inclusion of a chapter on asset recovery was considered a groundbreaking achievement at the time of the treaty’s conclusion in 2003. The treaty negotiations concerning these provisions, however, were highly controversial, and the discussions did not benefit from a substantial body of practical experience c…

  • Flexible Institution Building in the International Anti-corruption Regime

    Open Access•Laurence R Helfer, Cecily Rose et al.•ARTICLE•American Journal of International…•2023•Cited by: 1•References: 1

Asset recovery is a fundamental principle of anti-corruption law, without which the financial damage from corruption cannot be repaired. Yet recovering assets is notoriously difficult and time-consuming, and the United Nations Convention Against Corruption provides little technical or institutional support to facilitate such returns. To remedy this, we propose the creation of a transnational asset recovery mechanism that could provide myriad serv…

  • Appeal Relating to the Jurisdiction of the Icao Council

    Open Access•Cecily Rose•ARTICLE•American Journal of International…•2021

In two nearly identical judgments dated July 14, 2020, the International Court of Justice (ICJ or Court) reviewed a decision taken by the Council of the International Civil Aviation Organization (ICAO) in a dispute about aviation restrictions imposed on Qatar by Bahrain, Egypt, Saudi Arabia, and the United Arab Emirates (UAE). These cases represent the second time that the Court has heard an appeal concerning a decision of the ICAO Council, a tre…

  • The Creation of a Review Mechanism for the UN Convention Against Transnational Organized Crime and Its Protocols

    Open Access•Cecily Rose•ARTICLE•American Journal of International…•2020

In November 2000, the United Nations General Assembly adopted the United Nations Convention Against Transnational Organized Crime (UNTOC or Convention) and its three protocols on human trafficking, migrant smuggling, and firearms. These instruments are the product of three years of diplomatic negotiations, and they represent a substantial contribution to international lawmaking in the area of transnational criminal law. UNTOC has attracted almost…

  • The United Nations Convention Against Corruption

Cecily Rose, Michael Kubiciel et al.•BOOK•United Nations Convention Against…•2019

The United Nations Convention against Corruption includes 71 articles, and takes a comprehensive approach to the problem of corruption, as it addresses prevention, criminalization, international cooperation, and asset recovery. Since it came into force more than a decade ago, the Convention has attracted nearly universal participation by states. It is a global and comprehensive convention, which establishes new rules in several areas of anti-corr…

  • Justifying Arguments About Selection Procedures for Judges at International Courts and Tribunals

    Open Access•Cecily Rose•ARTICLE•AJIL Unbound•2016

This contribution considers why states as well as international courts and tribunals should act to remedy the gender imbalance on international benches. In my view, the most appropriate question is not why they must, but why they should. Arguments that states are legally bound under the UN Charter to address this gender imbalance are weak, though human rights law does provide a basis for claims that states must take action. But arguments about le…

  • The Limitations of a Human Rights Approach to Corruption

    Open Access•Cecily Rose•ARTICLE•International and Comparative Law…•2016•Cited by: 2•References: 31

International human rights law may serve as a language through which lawyers and others describe the harms resulting from corruption, but this approach has significant limitations as a legal framework. Despite a growing emphasis among scholars and practitioners on a human rights approach to the problem of corruption, this body of law does not provide a strong basis for addressing such conduct. International human rights treaties make no mention o…

  • International Anti-Corruption Norms

    Cecily Rose•BOOK•International Anti-Corruption Norms•2015

This book traces the creation of international anti-corruption norms by States and other actors through four markedly different institutions: the Organisation for Economic Co-operation and Development, the United Nations, the Extractive Industries Transparency Initiative, and the Financial Action Task Force. Each of these institutions oversees an international instrument that requires States to implement norms in their domestic legal systems that…

  • International Lawyers as Public Intellectuals and the Need for More Books

    Open Access•Cecily Rose•ARTICLE•Leiden Journal of International Law•2015•Cited by: 2

In the summer of 2014 I attended a conference panel on international lawyers as public intellectuals. The academics on the panel talked about their twitter accounts, their blogs, their occasional radio and television appearances, and their opinion-editorials in major newspapers. The discussion really focused not on whether international lawyers should be public intellectuals, but on how they can do so, and what the ramifications of such public en…

  • A Study of Lawyers Appearing before the International Court of Justice, 1999–2012

Shashank P Kumar, Cecily Rose•ARTICLE•European Journal of International…•2014•Cited by: 3

This article provides empirical support for what might strike some as a truism: oral proceedings before the International Court of Justice (the Court) are dominated by male international law professors from developed states. In order to test this claim, our study examines the composition of legal teams appearing on behalf of states before the Court in contentious proceedings between 1999 and 2012. We have focused, in particular, on counsels’ gend…

  • The Uk Bribery Act 2010 and Accompanying Guidance

    Open Access•Cecily Rose•ARTICLE•International and Comparative Law…•2012•References: 3

On 1 July 2011 the UK Bribery Act 2010 and accompanying guidance finally came into force, marking the end of years of controversy about how and when the United Kingdom would implement the OECD Anti-Bribery Convention. The United Kingdom's very delayed implementation of the Convention provoked an increasingly threatening response from the OECD Working Group on Bribery, and highlighted this body's lack of binding enforcement procedures. By contrast…

  • The Application of Human Rights Law to Private Sector Complicity in Governmental Corruption

    Open Access•Cecily Rose•ARTICLE•Leiden Journal of International Law•2011•Cited by: 2

This article examines private sector complicity in governmental corruption that violates economic and social rights. Although banks and multinational corporations typically play critical roles in facilitating the diversion of public revenues away from the provision of social services, the link between the private sector, corruption, and human rights violations remains underexplored. This article therefore examines this relationship and explores t…
