    Research on homogamy and heterogamy in mate selection has usually studied couples already engaged or married without comparing these selections with others which might have been made from the field of eligibles or controlling for influence of the couple's subsequent interaction.     In the assortative mating literature, attitudes have been regarded as homogamous. However, a study of the attitudes of couples who ultimately married each other prior to their serious involvement casts doubt upon early attitude similarity and suggests instead that attitude similarity may be the result of personal interaction and not necessarily present at the outset.     The Supreme Court is viewed herein as a barometer indicating the degree to which uncertainty is present in the attempt to resolve major social conflict through court decisions. Although certain aspects of uncertainty were disclosed, apparently the uncertainty was not the result of irresponsibility or caprice within the judicial system but rather of differences between the role of the Supreme Court and that of the lower courts of the land
