Prospecting, Expanding, Restoring
This special issue on Law and Extractivism in the Anthropocene explores the extractive machinery of late liberalism through the prism of law. Our introduction outlines the stakes and complexities of theorising extractivism and situates the contributions within this scholarship. The extractive sequence of the conventional mining cycle - prospecting, expanding, restoring - thematically organises the issue. From different points of departure, each a…
Nature is of God
In 1659, the English radical republican theorist James Harrington published one of his last works: a 10-page pamphlet of 76 aphorisms. The 22nd and shortest stated plainly 'Nature is of God'. Unpacking this otherwise enigmatic line, this article examines Harrington's changing uses of 'nature' as part of his thinking on law and empire, and argues that an early form of extractivism can be found in Harrington's thought. In the early, secular account…
The Fragile Power of Political Nations
This article examines Adam Smith’s concept of the federative: the double-facing constitutional power to conduct international relations today called the treaty or foreign-affairs power. We reconstruct Smith’s account of the federative from his major and minor works and demonstrate its importance in his account of law and empire. We first examine Smith’s early “internal federative,” where the power grows from the internal constitutional organizati…

Searching the Reins and Hearts
Conversion practices seek to change or suppress a person’s sexual orientation or gender identity. There is no scientific evidence to support the efficacy of these practices, and considerable evidence that they can cause serious physical, mental and social harm. Despite this, conversion practices have taken and continue to take place across Australia. Recently, Queensland, the Australian Capital Territory and Victoria statutorily proscribed conver…
Expertise, Public Health and the European Convention on Human Rights
In Vavřička v Czech Republic , the European Court of Human Rights held that the Czech Republic's childhood vaccination policy did not contravene the Article 8 right to private life. This note presents a rhetorical and contextual analysis of the Court's engagement with questions of expertise. The majority's application of a wide margin of appreciation avoided grappling with the details of scientific and medical authority, as much as the political …
Ambivalence, anxieties / Adaptations, advances
Scholars of the history of international law have recently begun to wonder whether their work is predominantly about law or history. The questions we ask – about materials, contexts and movements – all raise intractable problems of historiography. Yet, few scholars have turned to historical theory to think through how we might go about addressing them. This article works towards remedying that gap by exploring why and how we might engage with his…
The Oxford Handbook of the Theory of International Law
This Oxford handbook explores key questions and debates in international legal theory, offering new intellectual histories for the discipline, and providing fresh interpretations of significant historical figures, texts, and theoretical approaches.
Experiences of coming to law
While histories of law tend to examine the lawyers and judges involved through readings of the texts of transcripts and judgments, this contribution contextualises and presents a different and rarer artefact: the recollections of a client seeking to become part of a divisive, nationally significant case. The text here is a transcript that combines two interviews I conducted with Dr Bob Brown about his experience as head of the Tasmanian Wildernes…
Making sense of indigeneity, aboriginality and identity
This article is a conversation and encounter between an Indigenous and a non-Indigenous constitutional law scholar attempting to make sense of ‘race’ as it is written and interpreted in the Australian Constitution through a close re-reading of the Tasmanian Dams Case and the race power in s 51(xxvi). The conversation is intended to perform a conduct of jurisprudence in which the experience of law and the interpretation of law as a matter of doctr…
Mussolini
Benito Mussolini was a brilliant Socialist journalist who in 1914 declared war, put himself at the head if the anti-Socialist movement in Italy, manoeuvred himself into power by 1933 and ruled the country until overthrown in 1943. He was a dynamic but insecure personality, who appeared dictatorial but always had to share power with the military and bureaucratic establishment. Mussolini founded an Empire in Africa and tried to 'make Italians' in h…

The Italian Risorgimento
The Unification of Italy in the nineteenth century was the unlikely result of a lengthy and complex process of Italian ‘revival’ (‘Risorgimento’). Few Italians supported Unification and the new rulers of Italy were unable to resolve their disputes with the Catholic Church, the local power-holders in the South and the peasantry. In this fascinating account, Martin Clark examines these problems and considers: · The economic, social and religious co…

Unemployment, government training schemes and the perpetuation of marginality
Training for the unemployed has played an important role in recent labour market policies in the United Kingdom. The Employment Training programme, introduced in 1988, has been of particular significance during the recent recession. This program aimed to improve the skills of those who had been out of work for 6 months or more, to provide them with relevant work placements, and to enhance their employability. Evidence presented here, from in-dept…
