  • Supremacy and hegemony

Open Access•James Allan, David Campbell•ARTICLE•Journal of Law and Society•2021

In a 2019 article in this journal, which drew on previous work, we argued by examination of a number of extremely important cases that the senior judiciary is in the process of attempting to create judicial supremacy in the UK. It is doing so, not by democratic debate, but by legal procedural innovation incomprehensible to the electorate. Invited by the journal to reply to a criticism of our argument by Dr Stephanie Palmer and Dr Stevie Martin, w…

  • Procedural Innovation and the Surreptitious Creation of Judicial Supremacy in the United Kingdom

Open Access•David Campbell, James Allan•ARTICLE•Journal of Law and Society•2019

In Re an Application by the Northern Ireland Human Rights Commission for Judicial Review , the Supreme Court made unfavourable comments about Northern Irish abortion legislation in a way which showed complete disregard for elements of civil procedure which are a foundation of proper adjudication within the context of respect for democracy. James Allan targets four main, interconnected causes of decline - judicial activism, the transformation and growth of international law, the development of supranational organizations, and the presence of undemocratic elites."--Publishers website

Rights talk dominates contemporary moral discourse. It is also having a growing impact on the development of legal principle and doctrine. One of the best known general arguments in support of rights-based moral theories is the one given by John Rawls, who claims that only rights-based theories take seriously the distinction between human beings; only they can be counted on to protect certain rights and interests that are so paramount that they a…

  • Welfare-state decommodification in 18 OECD countries

Open Access•Lyle Scruggs, James Allan et al.•ARTICLE•Journal of European Social Policy•2006•Cited by: 153•References: 13

We present and discuss a replication and reassessment of the welfare-state decommodification index, and introduce a new, publicly available data set of key welfare-state programme characteristics. Using the same programme features used to create the ‘decommodification index’ in The Three Worlds of Welfare Capitalism, one of the most widely cited sources in the field, we are able to replicate the results quite closely. However, our investigation s…
