  • Institutional design in commons-based sharing economies

    Open Access•Bronwen Morgan•ARTICLE•International Journal of Law in…•2024•References: 8

This paper presents an analytical mapping of institutional design possibilities for alternative ways for digital platforms to institutionalise property and corporate form. It builds on the institutional imagination catalysed by three vignettes of experimental sharing economy initiatives presented towards the start of the paper, each of which highlights the imbrication and interdependence between economic and social dimensions of the sharing econo…

  • Prefigurative Legality

    Open Access•Amy J Cohen, Bronwen Morgan•ARTICLE•Law & Social Inquiry•2023•Cited by: 8•References: 19

Since the early 2000s, many of the left groups that spurred the alt-globalization movement have embraced directly democratic organizing and the creation of ethical relationships and subjectivities far more than they have pursued projects to reform legal and political institutions. These practices are often described as prefigurative because people are working to build alternative possible futures in the here-and-now outside of dominant statist an…

  • Prefigurative legality

    Open Access•Amelia Thorpe, Bronwen Morgan•ARTICLE•Urban Studies•2023•Cited by: 11•References: 25

This paper argues that prefigurative legality plays an important role in crafting municipalist strategy. We explore the experience of the City of Sydney in relation to new municipalism, focusing on its trajectory as a ‘boundary case’ that generates incrementally accrued transformative potential under conditions of muted political partisanship. The paper argues that at least in a boundary case such as this, legality can be a key and underappreciat…

  • Contested Common Space, Regulation and Inclusion at the Coogee Women’s Pool

    Open Access•Bronwen Morgan, Beth Goldblatt•ARTICLE•Legalities•2022

This article concerns two disputes that occurred between 2020–22 at the Coogee Women’s Pool, a public ocean pool in Sydney reserved for use only by women. One contest concerned the governance of the pool by its Management Committee related to differing conceptions of the ethos of the pool and the nature of its custodianship. The other concerned the exclusion of trans women from the pool over the definition of ‘women’ allowed access to the facilit…

  • Place-based pedagogies of hope

Open Access•Bronwen Morgan, Amelia Thorpe•ARTICLE•International Journal of Law in…•2022

The need to engage students in thinking about the politics of law, especially in a time of escalating climate and other crises, is increasingly urgent. In this paper, we discuss a series of place-based teaching strategies designed to foster critical legal thinking, but also hope and a sense of agency. Inspired by a range of scholars – Bruno Latour, Doreen Massey, Henry Giroux and J.K. Gibson-Graham – we use context in an effort to cultivate what …

  • What does a right to repair tell us about our relationship with technology

Open Access•Kayleen Manwaring, Matthew Kearnes et al.•ARTICLE•Alternative Law Journal•2022•Cited by: 1

This article examines the recommendations of the recent Productivity Commission Inquiry regarding the right to repair through the lens of social issues surrounding the right to repair movement. It describes the right to repair movement in Australia and globally and examines which repair practices are considered important by the Commission, and the limitations of the Commission’s preoccupation with existing repair markets. It also discusses changi…

  • The Sharing Economy

    Open Access•Bronwen Morgan•ARTICLE•Annual Review of Law and Social…•2018•Cited by: 3•References: 11

The sharing economy is an emergent field of scholarship. This review explores two clusters of debate regarding the sharing economy and seeks to discern the lines of a productive dialogue between them. It suggests that the current state of scholarship on law in the sharing economy is a complex and asymmetrical mix of narrative articulation and empirical exploration. The first cluster focuses on an on-demand commercial vision of the sharing economy…

  • Telling Stories Beautifully

    Open Access•Bronwen Morgan•ARTICLE•Journal of Law and Society•2018•Cited by: 1

This article explores the expressive and constitutive dimensions of hybrid legal forms emerging as vehicles for grass‐roots innovations that seek to forge renewed economic trajectories. Drawing on a relational perspective, it analyses company constitutions, and crowdfunding offers based on them. It explores the ways in which the practices of forming a legal entity and raising finance to support its growth relate to a broader narrative of creating…

    Open Access•Sangeetha Chandrashekeran, Bronwen Morgan et al.•ARTICLE•Wiley Interdisciplinary Reviews…•2017•Cited by: 4•References: 17

This study focuses on the role of the South African state in environmental governance, with particular reference to transformations in political authority and processes of capital accumulation. Our approach underscores the importance of analyzing state environmental efforts both empirically and normatively, in order to understand the underlying drivers of state policies that perpetuate or ameliorate environmental degradation. The tension between …

Open Access•Bronwen Morgan, Declan Kuch•ARTICLE•Journal of Law and Society•2015•Cited by: 4

This article proposes an original theoretical approach to the analysis of community‐level action for sustainability, focusing on its troubled relationship to the sharing economy. Through a conversation between scholarship on legal consciousness and diverse economies, it shows how struggles over transactional legality are a neglected site of activism for sustainability. Recognizing the diversity of economic life and forms of law illuminates what w…

  • Water rights between social activism and social enterprise

Bronwen Morgan, Sarika Seshadri•ARTICLE•Journal of Human Rights and the…•2014

Water rights involve an amalgam of property rights and socio-economic rights that possess an inescapable regulatory dimension. The resulting uneasy mix of public responsibilities and private property regimes means that the details of the legal entity structure involved are central to the viability and effectiveness of implementing water rights on the ground. Small-scale social enterprise structures offer a fascinating site for exploring the tensi…

  • I Fought the Law and the Law Won? Legal Consciousness and the Critical Imagination

Sharon Halliday, Bronwen Morgan•ARTICLE•Current Legal Problems•2013

The study of legal consciousness within socio-legal studies entails a focus on the ordinary, quotidian and, crucially, almost invisible life of law in society. To study legal consciousness is to study the taken-for-granted and not-immediately-noticeable: the background assumptions about legality which structure and inform everyday thoughts and actions. This article examines legal consciousness through the lens of the cultural theory of Mary Dougl…

  • Understanding the rise of the regulatory state of the South

    Open Access•Navroz K Dubash, Bronwen Morgan•ARTICLE•Regulation & Governance•2012•Cited by: 74•References: 73

This paper, and the special issue it introduces, explores whether, and how, the rise of the regulatory state of the South, and its implications for processes of governance, are distinct from cases in the North. With the exception of a small but growing body of work on Latin America, most work on the regulatory state deals with the US or Europe, or takes a relatively undifferentiated “legal transplant” approach to the developing world. We use the …

  • Water on Tap

    Open Access•Bronwen Morgan•BOOK•Water on Tap•2011

In the 1990s and mid-2000s, turbulent political and social protests surrounded the issue of private sector involvement in providing urban water services in both the developed and developing world. Water on Tap explores examples of such conflicts in six national settings (France, Bolivia, Chile, Argentina, South Africa and New Zealand), focusing on a central question: how were rights and regulation mobilized to address the demands of redistributio…

  • Turning Off the Tap

    Bronwen Morgan•ARTICLE•European Journal of International…•2006•Cited by: 6

This article explores the development of a cross-border dimension to the delivery of urban water services as an arena for the social construction of global administrative law. When companies from one country deliver water services in another country under decades-long concession contracts, the ensuing political and legal struggle engages one of the central strands of administrative law traditionally understood: the question of participation in de…

  • The Economization of Politics

    Open Access•Bronwen Morgan•ARTICLE•Social & Legal Studies•2003•Cited by: 16•References: 4

Recent developments in regulatory reform strategies increasingly focus on controlling the process of regulation itself, rather than regulating social and individual action directly. This article explores the reflexive systematization of regulatory policy by focusing on institutions and processes that embed regulatory review mechanisms deploying economic rationality into the every-day routines of governmental policy-making. It explores both the so…
