This came to be known as the “right to be forgotten.” This paper discusses the extent to which this right is consistent with the Islamic tradition. • The Relevance of Islamic Law to Non-Muslims in Muslim Juridical Sources

    Amr Osman•ARTICLE•ISLAMIC STUDIES•2021

A standard question in early and medieval works of uṣūl al-fiqh (the theory and principles of Islamic jurisprudence) was whether non-Muslims were addressed by the specific rules of Islamic law and meant to abide by them. Despite some evidence that it was rooted in legal issues that early Muslim societies faced, a later trend in uṣūl al-fiqh turned it into a rather pedantic subject irrelevant to real life in these societies, as some notable Muslim…

  • Abortion Laws in Muslim Countries

Amr Osman•ARTICLE•Muslim World Journal of Human…•2021•Cited by: 2

In most countries where Islam is acknowledged as a, or the , source of legislation, abortion is permitted under certain conditions and at certain stages of pregnancy. This article examines some of these laws and argue that they represent a continuation of the logic that governed the views of pre-modern Muslim jurists on abortion, that is, harm aversion. However, these laws also add a ‘modernist’ twist to that logic – rather than repealing that lo…

  • Abrogation in the Qurʾan and Islamic Law

    Amr Osman•ARTICLE•Journal of Islamic Studies•2016

Controversies over established views in Islamic legal history are usually sparked when their origins are challenged. More often than not, these challenges call into question the authenticity of these views, pointing to uncertainties and contradictions, or to deliberate distortions that secured their place in either orthodoxy or orthopraxis. In modern times, these challenges tend to be raised by authors who are not graduates of traditional religio…

    Amr Osman•BOOK•The Ẓāhirī Madhhab (3rd/9th-10th/16…•2014

In this book, Amr Osman seeks to expand and re-interpret what we know about the history and doctrine of the Ẓāhirī madhhab. Based on an extensive prosopographical survey, he concludes that the founder, Dāwūd al-Ẓāhirī, was closer in profile and doctrine to the Ahl al-Ra'y than to the Ahl al-Ḥadīth. Furthermore, Ibn Ḥazm al-Andalusī may have had a damaging effect on the madhhab, which never actually developed into a full-fledged school of law. By …

  • Human Intervention in Divine Speech

    Open Access•Amr Osman•ARTICLE•Journal of Qur'anic Studies•2012

Muslims regard the Qur'an as divine speech; therefore, the scope of human intervention in shaping and interpreting it is often downplayed. One hitherto neglected aspect of the history of the Qur'an and the redaction of its text is the introduction of waqf categories which dictate where a Qur'an reciter must, should or cannot pause while reading the Qur'an and how this affects its meaning. This paper deals with the history of the introduction of t…
